Having previously received statements, sent my claim letter to my local HSBC branch requesting total charges back. This was received 15th December - 14days ago.

Called the bank earlier tody to ask what is happening with my claim and I have been told that it is taking about 6 - 8 weeks to reply.

I mentioned that I was under the impression that I should have been acknowledged within 14 days. The lady told me that this was their normal 'complaints procedure' but as this was a legal challenge against the bank that was being dealt with by a special department in Leeds, they are allowed the 6 - 8 weeks.

Any advice for next step would be appreciated.

I'm also still awaiting contact from First Direct for a claims letter they have yet to acknowledge that was received 19 days ago.

You need to do what you'd said you'd do. Send your next letter.

They're allowed a reasonable time to respond. You will have given them a minimum of 21 days from your request. This is plenty for a bank with resources of this size.

As a reminder to others as well. Once you've started the procedure, there's virtually no point in phoning them up and asking when they're going to reply to your letter. It won't hurry things in the majority of cases and if it's also difficult to record accurately any conversation. Just follow the procedure.

I'm now at the point where I am ready to post off the second letter (the one threatening court action) but on the template letter, I don't know what to put in the INSERT NAME OF COURT bit.

    What should I put?
One hundred years from now it won't matter what kind of car I drove, what kind of house I lived in, how much money I had in the bank, nor what my clothes looked like but the world may be a little better because, I was important in the life of a child.
  • Got a letter today saying that they are not paying me as they don't think the charges are unfair because they are in the guidelines when you sign up....

    Next move people ????
  • I received a letter yesterday (a reply from my L.B.A. which was sent on the 9th December)
The letter states that they will be looking into the matters i have raised and they will contact me as soon as they have completed their investigations.
However i had put a court claim on line as i had'nt heard anything from Hsbc on the 21st December.
Do i inform the person who wrote the letter (Colin Langdale Senior Service Quality Officer) that because they were so slow I have put it into the courts hands or just ignore the letter/

You now have to tell them that you will be taking them to court and proceed with that via MoneyOnline.

If you claim on line it will be Northampton county court
If you put in your claim at your local court it will be where ever that is

    Good Luck

Initally yes, as this where MoneyClaim is based. However the case will be moved to your local court when allocated.
  • Well I sent my first letter 29/11 - claiming my bank charges heard nothing. I did have a "welsh-dragon" moment in that I claimed for interest charges too which I now know is incorrect. Anyway, I drafted 2nd letter asking for the correct amount (minus the account interest charges) and sent it 1st class recorded yesterday.

Today, I receive a letter from HSBC

    Dated 3rd January

Thank you for your letter dated 29th November concerning your request for a refund of bank charges. I apologise for not yet having fully completed my investigation. I will contact you again by 2nd February 2007 and expect to be able to provide you with a full response at that time.

In the meantime, I would like to thank you for your patience and enclose a copy of our leaflet which explains how these matters are dealt with.

Do I still stick to my timetable ? they will have received my letter today so in 7 days I can start court proceedings ?

    thanks

Hi Welsh dragon, i asked the same a few posts back but had no response, i had the same letter.
I have kept to my timescale and have filed a claim via moneyclaim, i did wonder whether to write and inform them, but i guess i informed them of my intentions in previous letters, so have not written to them again. Im still not sure if that is the correct thing to do.

It is the correct thing to do, always stick to your own timetable. I had a letter of hsbc asking me to wait a month. No chance! 14 days for prelim, 14 days for lba then file your claim if you dont get your money back.
