    Hey everyone,

    Need some desperate help in abit of a dilemma.

    I started my claim in feb, all wet fine til i got a bit eager and filed a judgeent tht hsbc had admitted to the claim, they hadnt I was being stupid and pressed wrong button, anyways since then DG Solicitors wrote to me two days befor ethe 28 days was up before i cud get default judgement, I ignored this and decided to proceed as only two days before the admisssion/chance to compile defence wa up, obviously they say they will defend as matter of course as just in case. Now they have wrote again but I want to just send off the set judgement form and order them to pay the claim.

    SO shall i

    a, get in touch with DG and say just recvd your ltr and unfortunately I have already filed for judgement at default as you didnt compile defence and way over 28 days now, and tht they shud of got brk down list from thir "client" hsbc.

    b, Send them the list and wait at least a month to be processed, this time line was mentioned in previous thread.

    c, just ignore them and file judgement anyways and kp fingers crossed.

    Im sick and tired of the whole chase game and its getting me down. any help to this poor thick boi would be much appreciated.

    I have just received a letter from DG the solicitors for HSBC, asking for a list of the charges.

    I was wondering if there is anything else that i should put in my reply, to speed them up and get an offer

    ok just a little update
    i filed for court on 25th april it was served on 2nd of may and they defended it on 3rd of may so they have till 30th may.
    anyway got a letter from hsbc this morning sayin that they have been advised that i have registered a claim with the courts and that the matter is now bein handled by their solicitors and i will recieve all future correspondence from them.
    should i be worried or is this just standard???
    should i call their solicitors or should i just wait for a letter or the 28 days to be up???

    No apparently they do this to just to cover there backs. In case they dop need to go to court.
  • Thanks to any advice I have been given in this thread, claimed 1800, they justifiedly took 150 off that as I had been refunded some of those charges (hadn't spotted this until ball was rolling), they refused any interest payment and got settlement for over £1050, accepted to save hassle of court and payment will hit my accuont by the end of today (i expect at 23:59:59 so they can get every 100th of a pennies interest they can)

    Anyway, not as much as I hoped.. but, at risk of turning this into a cliche, It was money that I thought i'd never see again

    I phoned HSBC earlier this afternoon and got a very shiRty girl on the other end of the phone, I was trying to explain that it wasnt satisfactory that my 8 weeks were up today, post had been and nothing, so I would like to speak to a manager. She told me that she would put my name forward to a manager but wouldnt be contacted before the end of the week. She also accused me of shouting, getting angry and not listeneing to what she was saying... when she was the one interupting me and getting snotty with me.... she changed her attitude when I took her name and told her I was reporting the case to the financial ombudsman.

    Phoned the FO waited about 2 minutes, spoke to somebody who gave me a reference number and told me to send all relevant forms to them and they would take the matter up for me......

    Finally out of my hands, I can't be doing with it anymore......

    Anybody whose waiting 8 weeks, don't hold your breath, HSBC say they are running at least 2 weeks behind, due to a surge of claims because of all the media coverage.... :mad:

    why contact the FO? Why not just raise it with the small claims court???

    Because I will settle for a partial amount of the claim and it sounds like the courts are busy so I think it will be quicker this way... we'll just have to wait and see???.....

    Sorry if I sound a bit daft but are you saying they wouldn't pay out for the charges that are described as 'total charges' on your account, because I'm claiming for loads of those?
    That's what i can only believe it's the total charges they are talking about, i can't think of anything else. Anyway i rang to speak to a manager about my offer and was informed that i would be called back within the next 48hrs hopefully i can haggle him for a bit more.

    Hi all,

    Update on my claim, got statements online and worked out charges to £3368 sent first letter claiming this plus interest on 05/03/07, recieved usual letter from Mr Langdale, dealing etc etc on 16/03/07, made a couple of phone calls but didn't follow up due to lack of finances and did not want to threaten court and not be able to follow it through, when finally in a position to carry on it was about 7 weeks after first letter, looking at a lot of hsbc threads it seem that people were filing online then getting offers after about 8 weeks, so thought would leave it for the 8 weeks, Hsbc stated that they started investigation into complaint on 12/03/07.. made phone call on 08/05/07 ready to carry on and was told that a offer letter had been sent that day, recieved letter dated 08/05/07 on 10/05/07 offering £2830.93. Phoned leeds on 14/05/07 to be told that it could not be discussed over the phone and i had to sent a refusal letter in and it would be reviewed. not happy with this phoned again about an hour later and different person told me that they would put me on the ringback list but it would take up to 48 hrs. Phone this morning and was told that I was on the ringback list but it was only put on it on 15/5/07 so expect a call tomorrow... 20 mins later recieved call from hsbc to discuss claim, told him i was not happy with offer and that the £85 of charges that they said I had been paid back I had not, he rechecked it for me there and then and apologised and said they had made a mistake, then offered me £3000, asked for £3300 and he said he could go no higher then £3000 as they will not pay out more then 90% of a claim, I said come on this is a negotiation :rolleyes: and said i would be happy to settle at £3150, ;) he said i bet you would, then said ok :eek: and he will get the offer out in the post today and expect to recieve it in 2 or 3 days.... I make that about 94% :D

    Seems HSBC are making a offer after 8 weeks, but if it goes to the court stage then they get their hard heads on and see it through for as long as they can.....

    Will post on the success thread when monies safely in my account....
