    Iam in the same boat as you ATM and my 8week deadline is up tomorrow.
    its not your problem that HSBC are snowed under with clames, they have told us to wate 8 weeks which we have done. and now they want us to wate some more! :mad:

    id take the MCOL route but i cant afford it. so it looks like il have to take them to court and waste the courts time because HSBC will just pay up before the court date.

    P.S. the reason they give for the £673.00 not being offered is HSBC overdraft interest on your account is well published in respect of both formal and informal overdrafts, it's a condition you will pay the agreed rates on that borrowing. God knows what their on about as i have never had an overdraft with them, but only can assume their referring to total charges.:confused:

    ring them up tomorrow and ask to speak to a manager regarding your offer , if they cant put you through they will get one to call you within 48 hours. When you speak to them you can haggle , this is what I did and I got and extra £300 out of them , I know others that have got the full amount this way.

    yeah , ring up tomorrow , no doubt you will be told something different , ask to speak to a manager or for a call back from a manager . I was told various things by the front line staff after 8 weeks of my claim, i rang every day and eventually spoke to a manager , my offer came after 8 weeks 4 days . Keep on at them , but try and speak to manager .

    I issued my two claims against HSBC on April 5th, since then they have acknowledged and defended with hours to spare and i have not heard anything, no partial settlement? Is this normal, i have read a few posts where HSBC have settled in the middle of a claim, worried now...this is HSBC's defence:

    1.The Claimant's account is governed by the defendants personal and/or business banking terms and conditions.
    2. Pursuant to the defendant's terms and conditions the defendant is entitled to make a charge for it's services as set out in the defendant's price list, including an overdraft review fee for considering whether to provide and providing the overdraft.
    3. The defendant denies that the charges applied to the claimant's account amount to penalties at common law and/or unfair contract terms for the purposes of the Unfair Terms in Consumer Contracts Regulations 1999 (UTCCR's)
    4. The charges applied to the claimant's account are reasonable and are properly and fully disclosed in the defendants Terma dn Condidtions and published price list. The charges represent the contractually agreed price for the services provided and the UTCCRs are not applicable to them: alternatively, they are not unfair contrary to the UTCCRs. Further, the charges are not default charges and accordingly, cannot amount to a penalty.
    5. Save as set out above, each and every allegation made by the claimant is denied. For the reasons set out above, it is denied that the claimant is entitled to the relief claimed or any relief.

    Hey everyone,

    Need some desperate help in abit of a dilemma.

    I started my claim in feb, all wet fine til i got a bit eager and filed a judgeent tht hsbc had admitted to the claim, they hadnt I was being stupid and pressed wrong button, anyways since then DG Solicitors wrote to me two days befor ethe 28 days was up before i cud get default judgement, I ignored this and decided to proceed as only two days before the admisssion/chance to compile defence wa up, obviously they say they will defend as matter of course as just in case. Now they have wrote again but I want to just send off the set judgement form and order them to pay the claim.

    SO shall i

    a, get in touch with DG and say just recvd your ltr and unfortunately I have already filed for judgement at default as you didnt compile defence and way over 28 days now, and tht they shud of got brk down list from thir "client" hsbc.

    b, Send them the list and wait at least a month to be processed, this time line was mentioned in previous thread.

    c, just ignore them and file judgement anyways and kp fingers crossed.

    Im sick and tired of the whole chase game and its getting me down. any help to this poor thick boi would be much appreciated.

  • This is my first ever post, even though I have been watching how everyone else has been getting on with reclaiming their bank charges for many months.

    On 22 January I wrote to HSBC to ask for £1,451 in charges for going over my overdraft limit. I didn't add on interest as I would be happy to just get back what they had taken from me. I received the standard letter to say they would investigate, then nothing. I then didn't do anything until I finally plucked up courage to send them a letter on 19 April to state that if I didn't receive a response within 14 days I would commence court proceedings - at which point I felt a bit faint with worry!

    Again I heard nothing. I thought I would then have to go through the MCOL online court process and panicked, but was determined they wouldn't get away with it. Before proceeding, I looked back through some of these threads and was confused as lots of people were talking about an 8 week deadline and said that the banks always reply within 8 weeks. I wasn't sure what this meant, so I dug out the leaflet that they initially sent with their first response which indeed did say that they would respond to all correspondence within 8 weeks - and I had heard nothing for 15 weeks. As lots of other moneysavers had phoned their banks first after this 8 week deadline, I thought I would do the same - anything to avoid that court hanging over me! After spending 40 minutes on hold, I finally got through to a guy who told me that a letter had been sent to me with an offer!! I hadn't received any letter at all, so I asked him to request for it to be resent.

    Today I received the offer letter of £1,351 (just £100 short of the full amount) which I am absolutely over the moon with!! Funnily enough, it is more or less exactly the amount of my overdraft, so at least it clears that!!

    I just wanted to give my story as I was of the opinion that this sort of thing happens to everyone else but me and I really didn't expect it to have a successful outcome. I so very nearly didn't bother writing that first letter in January or following up in April. Thank god I did!!

    To anyone wondering whether to go through with the court proceedings, I would recommend ringing the bank (HSBC in Leeds in my case, rather than local branch) and find out what the situation is before starting the proceedings.

    PS Check out Google Checkout.:D Until 11th JUNE certain suppliers give you a £10 discount on total goods valued above £30. They even say that multiple seperate buys will be accepted within reason! Just saved 20% on a pushchair!

    Unfortunately, and to their eternal shame, the banks aren't likely to cough up (except possibly for a paltry offer to get rid of you) after just a letter or two.

    Nagging tactics can be quite effective in some circumstances, but they could have "killfiled" your e-mail address!

    The court fees are based on the amount claimed - they start at just £30. However, lets not forget the Financial Ombudsman.
    The acquisition of wealth is no longer the driving force in my life. :)
