    This seems to be getting more and more complicated. Thanks for the link, I'm just glad so many people have done this before us and are able to post advice. Imagine being one of the first, it must have been very stressful.

    I know the paperwork seems like a waste of time but atleast it's quite reassuring to know their not going to take it all the way. My partner keeps joking and saying mine is going to be a landmark case where the claimant doesn't actually get their money back! Hopefully that's not going to be the case atall.

    I think I can safely say that all of us panic slightly that the one day has arrived and its us the bank have picked on! :wave: Gud luck, onwards and upwards.

    Had my offer letter on the 30th April which stated that I would receive my money in my account within 7 working days of them receiving my offer letter. I sent the letter on the 1st May by recorded delivery and they signed for it on the 2nd May. With the Bank holiday the money should have been in my account yesterday is that right? It wasn't and as I don't have a card as the cashpoint retained it a couple of weeks ago I have to keep going into the bank to check my balance. Is anyone else getting their money on time or are you having to wait longer then the specified time?

    I'm getting sick of waiting for mine.. My letter said 'upto 14 days' and that comes around on thursday. I rang yesterday and the chap in india told me that they are experiencing some delays...

    I've sent about 3 or 4 emessages off and had 'sorry for the delay, but we did say 14 days' in reply.

    Getting sick of waiting!

  • I cannot believe the amount of paper I am snowed under with. I thought this would be so simple. Now I can't even find my desk, I'm suppose to be working!

    It was only about 20 mins ago (I couldn't find it before that) I came across the basic court bundle on the CAG website and I am now in the process of printing all that off! I hope I haven't made any mistakes after all this.

    I need a personal assistant, any volunteers??

    I'm going through the courts to claim charges back from HSBC and 2 weeks before the court date, their solicitors have written to me saying that they can't account for £50 of the charges, but they will refund the rest in full. However, there is a catch.

    I had a debt with HSBC and they sold the debt on to a DCA (and I am making regular monthly payments to the DCA against this debt). They have said that if I accept their offer, then they will send the money to the DCA. I don't think this is fair. I do actually intend to use the money to pay off some of my debt but not just to this one particular DCA (I have other creditors).

    Does this seem right? They don't own the debt any more so can they insist on giving my refund to whomever they like? Surely if I'm being given money I should never have been charged in the first place I should get the money back?

    Can I insist that the money is paid to me or insist on going to court?

    Had the same offer from HSBC, they will make a payment to DCA, rather than to me. VVVV annoyed at this, as (assuming u and I in similar situations) I would like to use the money to pay off another creditor - smaller amount, but the repayments are proportionally higher than those made to Metro Collection Services - and then make higher repayments on the amount outstanding.
    I do believe others have raised this issue and the following URl was pasted as a guide to help.

    Have read it and will try to reply to HSBC saying I have not missed any payments in the agreed payment plan, therefore you do not have the right to 'set off' theis money against my debt.

    From what I said a few posts back, I eat my HAT!

    Just hope this doesnt cause people too many problems. It maybe Lloyds but you never no. My best to all those currently in the courts system and claiming system.

    has anyone got the number for the leeds customer service? I havent got it with me today in work. they said I was goin to get an offer by 9th may and I havent heard zilch. So I wanna ring up and see what they've got to say.

    Right, have now finished my bundle. 80 pages x 3. have no paper left in the house.

    Going to take it in to local court and send to HSBC tonight.

    VERY WORRIED ABOUT THE MAN WHO HAS JUST LOST TO LLOYDS WHO HAVE WON THEIR APPEAL AGAINST BANK CHARGES. THIS IS BAD NEWS - ANYONE GOT MORE DETAILS?
