    Remember , If the offer isnt the full amount , ring up and ask to speak to manager , I squeezed and extra £300 out of them and have read many cases of people doing the same

    Hi guys, I have been reading for a while, some very positive stories so far! I have recently taken HSBC to court following initial letter sent, LBA and being fobbed off.

    MCOL have confirmed that HSBC have acknowledged the case as of 11/05/2007, could anyone advise on what happens next?

    I am claiming £1072 which is inclusive of the interest.

    In most cases HSBC put in a defence then the case is transferred to your local court. In my case my claim was submitted on 21st March, acknowledged on 26th March and a defence was put in on 20th April then transferred to my local court. I've just received a court date through the post on Saturday for 13th August. This may give you an idea of the time it takes but obviously not all claims or courts are the same.

    So it could be a while yet before you see any dosh unfortunately, but still at least we might get it back eventually!

    I applied for and received 6 years of statements and requested payment of £186, HSBC replied saying usual stuff that they were unable to refund any charges so wrote and threatened the courts etc, had another reply saying theve credited £93 to my account, should i write and say not accepting or will accept as part of payment or just go stright to MCOL stage ? Thanks in advance

    Thats up to you. You could call Leeds, explain you were expecting more, maybe ask to speak to a manager. Or go down MCOL route, that will take longer then asking HSBC and giving them 8 weeks. But also remember that they gave you half and its whether you can be bothered to put in the time and effort to chase £93. A call to Leeds to speak to a manager is prob your best bet of help.

    i sent my 2nd letter on 8th May, the court threatening one. No reply as yet, do you think im likely to have to take this all the way !!

    Did you give them 14days in your court threatening letter? If so, I'd at least give them that. I doubt they would of read the letter till the 10th and there has been a weekend since then. Using the advise on here I'd decide what your going to do 14days after the received your 2nd letter

    The HSBC are starting to annoy me. I have been waiting since the 21st March for a full copy of the 6 years worth of bank statements.
    How are you waiting??
    Does anyone know how to get these six years of statements from the HSBC website, I am registered but i can only go back until Feb 07. is there anyway to go back further than this??:mad:

    After you click on the account you want on the left of the screen there will be a tab that says My accounts underneath this it will say (in order) my transaction, my statements, my charge summary, make a payment, transfer money etc etc. Choose my statements and a box will appear. Just choose the one you want and select continue. For any before Jan 06 choose next set Hope that helps. Statements will go back as far as May 2001 or when you opened your account if after

    I hope you have better luck than my girlfriend did yesterday when she rang Leeds. She's gone down the MCOL route and HSBC's solicitors have said they intend to enter a defence. We now have a date for court hearing however yesterday she recieved a letter of offer which worked out at roughly 60% of her total claim. She tried to negotiate with them on the phone but they were very rude and stated that if she didn't like the offer then send back their offer with a covering letter refusing it. Looks like we'll be in court on the 19th June then!
  • I'm going through the courts to claim charges back from HSBC and 2 weeks before the court date, their solicitors have written to me saying that they can't account for £50 of the charges, but they will refund the rest in full. However, there is a catch.

    I had a debt with HSBC and they sold the debt on to a DCA (and I am making regular monthly payments to the DCA against this debt). They have said that if I accept their offer, then they will send the money to the DCA. I don't think this is fair. I do actually intend to use the money to pay off some of my debt but not just to this one particular DCA (I have other creditors).

    Does this seem right? They don't own the debt any more so can they insist on giving my refund to whomever they like? Surely if I'm being given money I should never have been charged in the first place I should get the money back?

    Can I insist that the money is paid to me or insist on going to court?
