I have a similar problem as well, that the claim is slightly wrong, the amount that is, can this be thrown out because of the wrong amount claimed?0

I don't think so (I hope not!). I did notice on the defence they filed they had the option to defend some or all of the claim, so I'm hoping that a judge would allow the claim providing the correct amount is refunded (if it gets to court).Lightbulb moment - October 2005

Had my offer letter on the 30th April which stated that I would receive my money in my account within 7 working days of them receiving my offer letter. I sent the letter on the 1st May by recorded delivery and they signed for it on the 2nd May. With the Bank holiday the money should have been in my account yesterday is that right? It wasn't and as I don't have a card as the cashpoint retained it a couple of weeks ago I have to keep going into the bank to check my balance. Is anyone else getting their money on time or are you having to wait longer then the specified time?0

Just a quick question, I'm about to send off my court bundle today but I am still struggling with my covering statement. Can anybody give me an idea? I know what I want to say but I just wondered if anyone could give me tips on how they've worded theirs.

Coincidence - I'm just about to prepare my court bundle. There is something on the CAG website about this - basically it's 40 pages of supporting evidence. Going to take a look again and see what I can find out. At the moment I'm intending the covering statement to be brief and highlighting what I set out in my particulars of claim.

I spoke to Rob at D G Solicitors yesterday, he was very nice and helpful. He explained that they have no intention of taking me to court but have obviously defended to cover themselves. He said they would be paying all monies, interest and court costs up to date when they get round to my claim. Basically the sooner I get my statements/charges off to them so they can verify them with my account, the sooner I will get my money. He said they wish they could deal with the claims quicker but are unable to due to such a large quantity, it could take about a month.
I thought maybe I will fax my bundle over to them today (the sooner they get it the better) and then also send it recorded delivery.
You may like to do the same.

Blimey! They say they're not going to court but they are quite happy for us to get millions of pieces of paper together, spend a fortune sending them only to bin them???

Are you set up for ether internet or phone banking? On phone banking it usually tells you your balance without talking to en1 unlass they fancy selling you owt. If they signed on the 2nd then I make that the 11th. You should have seen your money on friday, at least yesterday. Give em a call, I have read of people being forgotten about and having to chase the money after it was agreed. Gud Lk.The will to save every money saving penny we can0 -

This seems to be getting more and more complicated. Thanks for the link, I'm just glad so many people have done this before us and are able to post advice. Imagine being one of the first, it must have been very stressful.
I know the paperwork seems like a waste of time but atleast it's quite reassuring to know their not going to take it all the way. My partner keeps joking and saying mine is going to be a landmark case where the claimant doesn't actually get their money back! Hopefully that's not going to be the case atall.0 -

I'm a bit stuck now. I've done all the stuff and submitted to MCOL which not surprise resulted in nothing. Everything was passed to my local court and i've received a letter from them today saying the following.
'District Judge Singleton orders that this claim is stayed until 4th June 2007 to enable the parties to attempt settlement.
Theclaimant do file with the Court, Further Particulars of Claim and do serve the Defendant with the same by 4th June 2007 after which date the file will be referred to the District Judge for further directions. In failure thereof the Claimants claim will be struck out.
The District Judges of this Court require the amount claimed is arrived at by specifying the date, amount and type of each charge claimed. It is not acceptable to merely file or annex copy bank statements even if the relevant charges are highlighted thereon.
This order was made on the District Judges own initiative pursuant to CPR Part 23.8. If you object to the terms of this order you must make an application to the court to have it set aside, varied or stayed within 7 days of receiving it pursuant to CPR Part 23.10.'
I rang the court and they told me that the Judge has decided to delay things in the hope that the bank will settle and that i am to send both the court and the bank yet another breakdown of the charges. The court also want from me a specific breakdown as to how the charges are made up, which obviously i can' give them because the bank put everything on my statements as 'total charges'. I did tell the court that i have sent breakdowns to the bank on several ocassions but apparently i have to do it again.
Can anyone help and explain what all this is about and what i should do.
