That's a good question, are notified fees & charges different? I thought they they were just the charge they make if you go overdrawn so have sent off to the bank (hsbc) asking for my last six years statements.A Life Less Simple - one day I'll get there0

Hi all, i've recently sent two letters asking for my charges back. I sent them to the branch that's addressed on my statements. I sent both letters recorded delivery the last 3 weeks ago and still not recived a letter of any kind. My letter to the card division was recived as i have had a reply but that was sent to the address in london. I rang the bank the other day and they were going to get someone to call me to confirm that the letters had been recived. I'm not sure what to do next send another letter to the london address or just to go to court which would be the next step of action anyone any thought:beer:0

 I have finally got a court date through the post this morning. I have the general idea of what to send in my court bundle, I will put in the charges I've printed from my internet banking (as I didn't send off for statements) plus the first 2 letters I sent to HSBC requesting refunds for charges and I am also going to put in my MCOL claim which shows the £120 I've paid. Could somebody please tell me if there is anything else I should put in?
The bit that has got me is the covering statement?? What should I say? I have looked at the replies to the allocation questionaire on the thread posted by Rex_Mundi, but I haven't received an allocation questionaire with my court date, does this mean I won't be getting one?
I know there are a few who are at this stage so help from any of you will be most appreciated. I have sent an e-message to HSBC offering to settle out of court for the full amount, I am currently waiting for a response from D G Solicitors on their behalf. We live in hope of an early settlement!!
By the way my court date is..................13th August!!! That's weeks away! But I'll be checking my mat everyday til then in hope of a settlement letter.0 -
After reading all the info and sucess stories on here I thought I'd go get some money out of HSBC for all the stress and hassle I've had over the last 10yrs with them. 18months of those they were taking out a direct debit every month that I hadn't authorised (it was actually for my ex wife and started in my account after we had split up!!). The total I paid was over 1k, so they aren't my favourite bank. I did get it back, but only when I kicked up a huge stink as they only wanted to pay me one payment.
Anyway I sent off for my bank charges on Sat 28th April and enclosed my £10 cheque. As letter was sent recorded I saw they recieved it on the Monday and was stunned when 2 huge envelopes turned up on the Wednesday (2nd May). After hearing of people waiting 40 days, I was very suprised. I went throught the satements and totted the charges up and wow.....
£3430.50. After using the interest spreadsheet on the main page I worked out
£3430.50 charges + £654.75 interest = £4085.25 :j
I sent my first letter asking for repayment on Thursday 3rd May and they received the next day. Now to sit back and wait.
I checked my bank account today and discovered they had cashed my cheque. I was livid!! Not only do they not charge for sending statements (I could get these off the internet) but guess what...... I'd gone overdrawn. I rang customer services and they apologies and promised to pay me back in 3-4days. Grrrr. I told them I would not accept any charges as a result of this.
Do HSBC not learn? As i was rather annoyed I asked the girl on the phone if she could also send out my statements for my credit card that was shut down in 2005 (by them as a result of not great management but not helped by loads of charges). She has done that for me so I'm now off to try to get as much back from that too. As its closed with 0 balance I have nothing to lose. If they hadn't cashed my cheque I'd prob not of thought about my card.Wage Day Advance, Quick Quid, Pounds to Pocket and Pounds Till Payday....i'm after you0 -
Firstly a huge thanks to Bishop Stoke who answered my query before - I am so grateful.

A couple of weeks later I received a letter claiming they had received no correspondence from me, and if I didn't reply they would consider the matter "closed" (not their decision, I would have thought!). I immediately sent them a scanned copy of the original form with an accompanying letter, via recorded delivery this time (I had not sent it recorded last time). Now checking the claim on Moneyclaim online, I can see they have entered a defence:
"The Defendant disputes the whole amount you have claimed. Your claim cannot proceed online and will be transferred to the appropriate court for continuation. You will receive confirmation to where the claim has been transferred to shortly."
Thats standard proceedure. Dont be put off, they always enter a defence - guess the 'Big Boy' tactics work with a few customers, in other words if your bank plays hardball some go away.
Help!!! What do I do now??

Dont worry about it, in a few days you will get a 'Notic of Transfer of Proceedings' from your local court. Sit it out and wait till you recieve your allocation questionairre. When you get it, phone up your bank (HSBC i assume) and tell them you would like to settle out of court for the full amount you are claiming. They wont offer it initially, but make it clear that you intend to take it all the way and go to court if necessary. See what happens next.
I received my Notice of Transfer of Proceedings today. It includes an order from Northampton County Court that "Filing of an allocation questionnaire be dispensed with in this case unless the judge at the court of transfer orders otherwise".
This sounds a bit ominous - what does it mean??
HSBC have entered a 5-point defence on the form too.
I guess my questions are - what do I do now? Is this just yet more stalling from HSBC? Why has the judge recommended that no allocation questionnaire be filed?
Any help is so appreciated - this stuff stresses me out.
Many thanks

Just posted this on the Success Stories thread:
Bank: HSBC
Amount Claimed: £1807.50 (+£334.18 interest)
Repaid: £1669.50
Send first letter asking for my charges back 07/03/2007. Got the usual "We are looking into it" reply.
Sent a letter threatening court action 26/03/2007 and heard nothing.
Was too busy/away to actually file an MCOL claim but got a letter from HSBC yesterday saying they were willing to give me £1669.50 "in full and final settlement". Going to accept this in wiriting this week.
Interestingly they also stated that I had claimed back beyond 6 years... it is more than 6 years now as I've waited 2 months for a reply!
Anyway, good result that didn't need anything more than a couple of letters from me. :-)
Note that the first letter was sent to my branch, the second to the Quality Service Team in Leeds (but cc'ing my branch).
I've also just worked it out and I got my offer almost exactly 8 weeks to the day after they responded to my first letter.0 -

I've just been going through my bank statements online, didn't know I could do that until reading this thread this morning, and adding up all my charges and at the beggining of this year charges changed from "total charges to..." to "NOTIFRIED FEES/CHARGES TO..." the charges seem to have gone down as well, one of them is only for £12, can I claim these? At the start of this month I got a letter from HSBC explaining their 'fair charge policy' and why they had to charge me this month. Is this them trying to put me off claiming or have they started to only charge what it costs them? Anyone know?A Life Less Simple - one day I'll get there0
