hi!I have written to hsbc to claim back my charges on an account i closed over 1 year ago. i wrote on the 29th march asking for statement copies. they haven't cashed the cheque and nor have they sent the statement copies. so.... as i type this i am on hold (08456028006) listening to this dreadfull hsbc theme tune and find it so infuriating. has anyone else waited over 40 days ?
i know that the ico is next step but was hoping they would bite the bullet and cooperate!!!

I spoke to HSBC yesterday about an offer letter they are sending and gave me a fax number i could use to accept the offer - lovin' their optimism!! - the number is: 0113 2766202.
Hope this helps, I realise it takes a while on the phone, but worth sticking with it

Hi!
HSBC seem to have a very strict 8 week timetable, and they should respond with an offer letter. Only thing is, if you don't hear 8 weeks after your first letter (assuming you sent all the info in the 1st letter) , then get on the phone 08456028006 - you'll be on hold for a while depeding on when u call - and start asking questions, and keep calling till u get the letter.

I received the following General Form of Judgement or Order from Exeter County Court this morning, im now more than a little concerned about what i should do next, please could someone offer me some advice.
The General Form of Judgement or Order said:
"Before DISTRICT JUDGE WAINWRIGHT sitting at Exeter CC, Exeter and County Court ect...
Upon reading the court file
IT IS ORDERED THAT
1) The District Judge has allocatedd to the small Claims Track and has made the following directions
2) Within 21 days of receipt of this order you shall deliver to every other party and to the court a) signed statements containing your evidence and the evidence of any witness whether or not you intend to call that witness to give evidence at the court
b) copies of all documnets which you intend to rely (the originals of such documents must be brought to the hearing)
3) You shall not be entitled to rely upon any expert witness unless you first obtain permissionm from the court and for this purpose you will need to issue an application.
4) If you fail to comply with these directions, this ay prejudice your case
5) List for hearing on FIRST OPEN DATE in block list
6) You must inform the court if the claim is settled by agreement before the hearing date.

HELP ...... Firstly i havent got a clue what it means in section (2 a) - do i now supply the solicitors for HSBC with my statements or spread sheet even though they havent asked for it? What else should i be giving them it says signed statements containing evidence? Section (2b) Copies of all documents i intend to rely on? What do i send ? Section (4) Does this mean i should get a solicitor and inform the court that they will now be representing me?Section (5) What does this mean? Do i have to apply for the first open date for court and if so how?
Sorry for all the questions but i have no idea what i should do and realy need all of your help.

Sent letters to HSBC regarding £610 charges. They declined so started court action which is scheduled for 25 July at my local court. Fingers crossed!!
Also I have a query if anyone can help, my apologies if it`s posted in wrong place.
My previous lettings agent charged me (a few times) £30/week for late payment of rent. Am I correct in thinking that I can use the same principal as with the banks to reclaim it?
Also I have a similar issue with Studio cards who have charged me £20 several times for late payment. Can I claim these too?
Any advice can be posted or emailed direct

I sent my letter 8 march got standard reply saying looking into it, followed up with phone calls every few weeks each time advised they have 8 weeks to respond, 8 weeks were up on tuesday phoned and was told i should receive offer by end of week was getting thoroughly peed of by thursday and was going to give them hell when a letter dropped through letterbox
i was claiming for 1824.00 and they offered 1571.00 which was quite a bit more than the minimum i'd decided i'd accept, i never sent any lba as was too scared to go that route but if you want to do that i think you do it after 14 days

I'm no expert as I haven't got this far yet, but I'll do my best, so here goes...not sure about signed statements containing evidence, but what you should send as in (2b) is all the letters that you have sent to the bank asking for your money, all the statements that show the charges you have been charged and any other correspondence between you and the bank regarding this matter. Section (4) is saying that if you do not send in the necessary information, this may work against you because the judge will not be able to make an informed decision regarding your case if the bank don't turn up on the day. You don't need to employ a solicitor unless you really feel that you need to, but everybody else seems quite happy to do it alone because it is unlikely that you will even see the inside of a court room. They will probably settle before you get there. Finally, section (5) is instructing that you be allocated the first available court date. If you need any further advice I tune into the Alliance & Leicester thread regularly and there is plenty of information on there about court procedures, as A & L are allowing virtually everybody to file a court claim. Hi everyone
I have just completed my claim with HSBc for £290.00, my first letter went in on March 15th, I received the 8 weeks to reply holding letter. since then I have made 2 calls to progress chase this and yesterday was told that my case would be looked at next week ( week 8 ) but was also advised that as it was so close to the 8 week date they would move my letter to an escalated level to be delat wiht within 48 hours! this morning I received an offer letter from them for £315.00 without interest included. I have two other claims going through re credit cards for which i have recd partial offers and will be going down the MCOL route but thought that Id give the HSBC the benefit of the doubt to deal with my claim!
By the way im not advising you not to claim online !!just thought you guys would like to know that there can be a successful outcome to a claim.0 -

hi there, I submitted my first letter ( claim for £290 )approx 8 weeks ago to the London address and recd holding type reply from the Service Quality Team, Arlington Business Centre Millshaw Park Lane, Leeds. LS11 0PP. They quoted the FSA have stated they have 8 weeks to reply which in effect is up on Tuesday of next week. chased it again yesterday on 08456 028006 kept on hold a short while and was told that as the 8 weeks was nearly up they would deal with this within 48 hours - guess what ....letter arrived this morning offering a full refund of £315.00 with a form to complete within 10 days to accept !!
One down and two to go!!! Capital One and HSBC0
