I am now at Step 5: Take it to Court... Within 2 days HSBC had acknowledged my claim.
I am hoping that this is just HSBC's way to prolong things and they won't do anymore than that.
Can people who have come this far or further, who have experienced the same please reply to this post and put my mind at rest.

That damn customer service call center 08456028006
I called them dead on 9am, and wated 32mins on hold then my credit ran out!
so i had to spend more money to call them on their normal number,
they then spent another 30 mins trying to get thru to the same people i was before.
i was then told because they couldent get thru to the department that deals with peolple who ask for there charges back was to bussy, and was promissed HSBC would call me back before the close of the bussiness day. :rotfl: .
do i now make a complante to the Financial Ombudsman or send the letter saying iam going to take court action?
does it matter if i do not have the origonal letter asking for the ammount of charges back? i have a copy of the charges list tho.0 -

Unfortunately HSBC will more than likely defend the claim right at the last minute. It's nothing to worry about though, usual stalling tactics! This is what happened to me, i received a court date therough the post this morning, in August!!! How much longer can they drag it out, started this in February, cant see any light at the end of the tunnel!0 -
I arrived home to find an offer from HSBC for £2,622.00 instead of £3295.50 with interest it's £4078.70. I have waited the 8 weeks which they requested as i did not have the money to do MCOL. But i feel that i should be entitled to at least the £3295.50 how do i try to get the remaining £673.50. Should i call them and to whom do i speak to and say what? or do i do this in writing.

P.S. the reason they give for the £673.00 not being offered is HSBC overdraft interest on your account is well published in respect of both formal and informal overdrafts, it's a condition you will pay the agreed rates on that borrowing. God knows what their on about as i have never had an overdraft with them, but only can assume their referring to total charges.
You should be accepting this. You aren't entitled to interest until you take your claim to court. You cannot claim overdraft interest anyway so I would suggest you hurry up and accept!!!Lou0 -
i was not claiming back overdraft interest in my charges it is the total charges which this website state i am entitled to claim back, it is the Hsbc which is trying to change the word from total charges to overdraft interest.Also i know that interest can only be give or included once you go to court.You should be accepting this. Typical and not surprising that HSBC will drag it out. I had no response from HSBC from all of the templated letters, I'm so glad I had then recorded otherwise I would of asumed they didn't get them.
Well I am prepared to go all the way and I actually look forward to going to court (if need be) as I have never been before

Just to let you know of the developments with my claim over the last 24hrs.
I sent an e-message online to HSBC on 8th May offering to settle out of court for the full amount, I followed this up with a telephone call but was told that it was 'out of their hands' as it's now going to court and that I should call DG instead. Yesterday I came home to find a letter from HSBC, Mark Locker, thanking me for my request and asking for a full breakdown of charges for the last 6 years, and any I may have incurred since, in order for them to consider my claim? Thought they said they couldn't?
I then spoke to a guy at DG, who again was ever so nice and helpful, I explained to him that I was putting together my court bundle, which has to be completed by 8th June, but I'd received this letter from HSBC. He told me if I could fax him over all the info he needs ie statements and schedule of charges, he can be dealing with my claim, which would likely be settled before 8th June anyway. :j
I couldn't stop smiling last night, that was until my partner came home and told me I wasn't the first landmark case to lose at court, he'd heard on the radio that someone had beat me to it! Oh dear, where do we stand now?
Anyway for anyone who is at the same stage as me, call DG and see if you can't speed things along, their very friendly and helpful (for now anyway).0 -

Sorry if I sound a bit daft but are you saying they wouldn't pay out for the charges that are described as 'total charges' on your account, because I'm claiming for loads of those?0 -

Any chance you've got DG's number as im stuck in work and all paperwork is at home, im in the same position as you with regards to my claim, had court date of 16th August this morning but don't want to wait that long! Plus im sure it will look better from the courts perspective to try and get them to setlle out of court, through this whole process i have not had any communication from HSBC so think its time i did the chasing!

Their number is 0121 455 2701, but don't expect anyone to answer, leave a message and they'll call you back. I've left a couple of messages around 8am, on separate occasions, and got a call back around 4pm so that must be when they get round to checking the messages.
My court date is the 13th Aug, seems like ages away. I hadn't received any communication either, before yesterday, other than the acknowledgement letter at the very beginning.
