    The banks will try to drag it out as they are treating your claim as a complaint and they are allowed 8 weeks to deal with it by the FSA. You dont have to wait and can file claim now at court. I researched HSBC in the Success Thread up to 98 pages and found the following:

    HSBC - 115 cases of which:

    72 cases settled for less than the amount claimed but for not much less than claimed, presumably without interest
    32 cases were settled in full without the need for court and some after the first letter only
    7 were settled for more than the claimed amount, no mention of court in these cases and I assume interest was given before court

    Of 4 court cases noted:

    2 were settled in full by, the bank did not defend and default judgement was awarded after 14 days
    1 settled in full after court claim filed
    1 settled for less after court claim filed and it was accepted by the claimant

    I sent my first letter 8th march claiming £1,824.62 and decided to wait the 8 weeks as i was scared to go the mcol route, followed up with phone calls every few weeks which didn't acheive anything, anyway 8 weeks were up on tuesday phoned again and told they are really busy but should get a letter by friday, decided today that i was fed up with stalling tactics and was going to get it sorted out but received a letter today offering £1571.00 which i am going to accept, so for all of you not willing to go the mcol route you will get an offer i didn't really believe that this would happen especially as my husband said you won't get any money back!!!!

    My 8 weeks are up on the 23rd. Thats when they signed for the 2nd letter, the 1st royal mail lost even tho it was recorded! But, 1 letter and 2 e-mails later I have still had no corrispondance from them. As its my husbands account I am having to wait for a 3rd party mandate to go through before I can call and their dragging their heals with that. Am just worried that am gonna call next week and their gonna say they have no details of the claim and try and fob me off with another 8 wks. Am not gonna let them but has en1 else not recieved any corrispondance and still recieved an offer letter at 8 weeks?

    I would be tempted to do it myself as I already have a parachute account, take a look at the settlement letter of your first claim (if you've had it yet) and it might advise you that the account will be closed if you claim again.

    it's still your money you want back though!

    It says nothing about them closing my account in the letter so I am taking my chances - it is a fairly small amount.

    Can anyone help please ?
    I started court procedings on 19/04
    Deemed to be served 22/04
    Notified of Acknowledgement of service on 26/04 to defend all the claim.

    the way I understand it now, they have 28 days from 22/04 (sunday)? to submit a defence. I make that 20/05 (again a sunday). If no defence has been submitted to the court by then, on Monday 21st I can ask for judgement.
    Is that correct ?
    Please help , I don't want to get it wrong.

    crrthrspl - I think thats right, however i understood it to be 28 working days not 28 normal days. However i could be wrong! Good luck with the waiting game HSBC are driving me crazy!

    Any other MSE member's - PLEASE HELP
    I received the following General Form of Judgement or Order from Exeter County Court this morning, im now more than a little concerned about what i should do next, please could someone offer me some advice.

    The General Form of Judgement or Order said:
    "Before DISTRICT JUDGE WAINWRIGHT sitting at Exeter CC, Exeter and County Court ect...

    Upon reading the court file

    IT IS ORDERED THAT
    1) The District Judge has allocatedd to the small Claims Track and has made the following directions

    2) Within 21 days of receipt of this order you shall deliver to every other party and to the court a) signed statements containing your evidence and the evidence of any witness whether or not you intend to call that witness to give evidence at the court

    b) copies of all documnets which you intend to rely (the originals of such documents must be brought to the hearing)

    3) You shall not be entitled to rely upon any expert witness unless you first obtain permissionm from the court and for this purpose you will need to issue an application.

    4) If you fail to comply with these directions, this ay prejudice your case

    5) List for hearing on FIRST OPEN DATE in block list

    6) You must inform the court if the claim is settled by agreement before the hearing date.

    Dated 27th April 2007

    HELP ...... Firstly i havent got a clue what it means in section (2 a) - do i now supply the solicitors for HSBC with my statements or spread sheet even though they havent asked for it? What else should i be giving them it says signed statements containing evidence? Section (2b) Copies of all documents i intend to rely on? What do i send ? Section (4) Does this mean i should get a solicitor and inform the court that they will now be representing me?Section (5) What does this mean? Do i have to apply for the first open date for court and if so how?

    Sorry for all the questions but i have no idea what i should do and realy need all of your help.

    Hiya has anyone got a contact phone number for hsbc`s service quality team please ? Or an email address . Were fed up of being sent from pillar to post trying to find some answers about our claim for our charges back .

    the people you spea to are ok and helpful but I have been told conflicting things by them before(i thin they are just firefighting) Ask to speak to a manager and say you want call back.
    HSBC Claimed £2519 , Paid £2300 - cheque recieved
    Capital One Claimed £300 , £144 offered , court threat 09/05
