    hi just a couple of questions.

    .i sent the first letter off to the bank (along with the 10 cheque) asking for a run down on my charges for the last six years waited the full 40 days and then on the 40th day i got a letter saying.......




    thanks for your request with regards to information about transactions and charges/fees on your account.

    We note you did not request copy statements, however, this is the only format in which the bank holds the information you require. for this reason copy statements have been ordered on your account. these will begin to arrive in separate batches and will be with you shortly.

    we are happy to waive any fees for the production of this information and in order to protect your securtiy, we have destroyed the cheque you sent on bank premises.......




    can anyone tell me if this an attempt to slow me down from claiming back my bank charges by sending all my bank statements for the last 6 years bit by bit ? and what would be the best course of action to take ?so infact its over the 40 days and i still dont have anything i can do to get my money back.

    It actually sounds like they are helping you out. However, you could register for internet banking and have all the information to hand and charges calculated within 30 minutes.

    They have 28 days to file a defence from the date that the MCOL paperwork is served - you will be able to check this on your MCOL internet account, and also on the acknowledgement paperwork. If HSBC are true to form, they will wait till the last minute to file a defence, you will then get a 'Transfer of Proceedings' notice sent to you and in due course an allocation questionairre.

    Nice one bishop :beer: , HSBC have just defended both my claims at the last minute! Hope they dont drag it out too much but just know theyre gonna!

    I have finally after 10 months got my bank statements from HSBC.... I didn't complain to the IC (didn't even know I could) and HSBC have admitted that it was there fault that I did not receive my statements as I had asked for them

    Questions:

    1) Can I therefore claim 6 years back from July 2006 rather than now?
    2) Can I include some damages as a result of this?

    The debt statue barred rule does not com into play as because they have accepted you can start from when you opened your account.

    Hello

    I've sent my letter before action off to HSBC today. I'm expecting to take them to court after the 14 days are up. So i'll be filing with MCOL. Do you file one claim for multiple accounts, or one claim per account? We have 4 accounts with them, so would want to avoid having to pay for 4 claims!

    Anyone help with this question?
    1st letters received on 16.02.07 for HSBC, Goldfish, Tesco, RBoS & Lloyds TSB

    Amount Claimed: £2582.50

    Ok, I looked up online for 6 years worth of charges, totalled them up & got to the figure above. So, I sent off my first letter - signed for, gave them 14 days to reply. No response so snt 2nd letter - signed for. 2 days later, recieved letter from HSBC requesting a breakdown of all charges (surely that's up to them to sort out???) which I had already sent in the 2nd letter. I gave them the dates & amounts, not what the charge was for.

    Tried to send email to bank from online bank website, got a response to say that it was being looked into.

    This all started in Early March. Still haven't heard back from the bank, so have visited MCOL & completed claim.

    Now I shall sit & wait.

    Has anyone else any experience of HSBC at this stage?:eek:
    Please let me know how they tend to proceed.

    HSBC made me on offer of twenty quid or so below what I wanted (500 quid or thereabouts) on the grounds that they said the interest was too much. I accepted it, and sent the reply form back to them on the day I received it. A couple of weeks later I received a letter claiming they had received no correspondence from me, and if I didn't reply they would consider the matter "closed" (not their decision, I would have thought!). I immediately sent them a scanned copy of the original form with an accompanying letter, via recorded delivery this time (I had not sent it recorded last time). Now checking the claim on Moneyclaim online, I can see they have entered a defence:

    "The Defendant disputes the whole amount you have claimed. Your claim cannot proceed online and will be transferred to the appropriate court for continuation. You will receive confirmation to where the claim has been transferred to shortly."

    Help!!! What do I do now??

    Thats standard proceedure. Dont be put off, they always enter a defence - guess the 'Big Boy' tactics work with a few customers, in other words if your bank plays hardball some go away.

    Dont worry about it, in a few days you will get a 'Notic of Transfer of Proceedings' from your local court. Sit it out and wait till you recieve your allocation questionairre. When you get it, phone up your bank (HSBC i assume) and tell them you would like to settle out of court for the full amount you are claiming. They wont offer it initially, but make it clear that you intend to take it all the way and go to court if necessary. See what happens next. :p
