    Hi

    Sent my LBA to HSBC on Monday :). All week have been happily using card. Tried to withdraw cash today, only to find machine's swallowed the card! :(. Phoned HSBC to be told that this couldn't be discussed over the phone, but woud have to go into branch. Are the two events connected I wonder??

    Funny - when they were taking money, they could discuss it all day on the phone.... As soon as I have a problem. they won't discuss over the phone!

    Not too worried as have set up parachute anyway. I had a feeling this might happen :D

    I would honestly doubt that these events are connected. I would ring up again, you might get someone else - albeit in a different country but you might get an answer...

    A directions hearing is simply where the judge will tell you what he intends to do with the case. He is giving his directions which might well involve throwing the case out if they haven't filed the bundle. Have you filed your bundle? This might well end quickly, but don't want to get your hopes up - he might suggest that you both are given extra time to negotiate between you - this has happened a lot in these cases.

    Thanks for that. I might go into the local branch on Tues to slug it out with them. As I say, am not too bothered as already have a parachute account which I've arranged for my salary to be paid into...

    I am claiming just over £2000, have sent both letters to HSBC (local branch, I did this without MSE help, wasn't aware of it all here!!) First letter got a 'we'll look in to it, but terms and conditions of account' etc letter, second letter got no response. Today I have submitted a claim on Moneyclaim, paid my £120 (OUCH!!) and now have to wait and see...
    I am quite scared about this new legal world I am entering- what happens now? I know that it takes 5 days before the 14 day countdown can begin. Is it 5 working days? Moneyclaim says it will start 10am 'the next day' but will that be Tuesday? I want to make sure I know the exact time/date when the 14 days is up do I can go on to the next step.
    Given my current luck, they'll defend, I'll loose and have to pay costs too. *sigh*:confused:

    If he gives us extra time to negotiate does this mean interest keeps accruing? Am I still entitled to the interest?:confused:

    :mad: HSBC have put in a defence on both my claims today as they only had until Tuesday!! I'm so hacked off! Grrrrr:mad:

    Just wait for your letter from MCOL which will give you the date they were deemed to be served. Just add 5 days then they will acknowledge, then they will file defence just before the 28 days are up, then you will get a Notice of Transfer to your local court, then a court date, then you'll get paid out just before this date. And no, you will not lose, that would be highly unlikely. You're playing the waiting game at the moment.

    Hello

    I've sent my letter before action off to HSBC today. I'm expecting to take them to court after the 14 days are up. So i'll be filing with MCOL. Do you file one claim for multiple accounts, or one claim per account? We have 4 accounts with them, so would want to avoid having to pay for 4 claims!
    1st letters received on 16.02.07 for HSBC, Goldfish, Tesco, RBoS & Lloyds TSB

    i've sent the first 2 letters and their 14 days is up on monday and i will then be putting in my claim to the courts. the thing is i have no response from them at all?!! i have checked with royal mail to make sure my letters had been signed for and they have so i wonder why i haven't recieved any response grrrr to hsbc! Has anyone else just been totally ignored??

    Finally got the offer from HSBC in the post, 8 weeks and 5 days , was alot of messing about with calls after 8 weeks as they kept telling me conflicting things over the phone.

    Claimed £2636 (no interest)
    Offered £2096.10

    They said £117.50 had been previously refunded which is fair enough.

    I've no idea why they have shaved off the other £480 though.

    Is it worth trying to get this back ? Obviously I'd rather have this amount than 2 months of court but still cheeky taking almost 500 quid.

    It has done my nut a fair few times this process , but patience is the key , it does come good
