    Yes, if you'd started the court claim before they'd offered, i would carry on with court action. You're automatically entitled to claim the interest and costs until the date of judgement. I think you may have a problem with the 6 year thing, but you need to look through the site and CAG's site to see what it all means, you could be lucky but obviously don't want it to influence any decisions on your overall claim.

    You should always be asking for your court costs back no matter what they offer. The court will award them anyway.

    If you read through this thread, tedious but enlightening stuff, you'll see that your offer is a good one and that if you're not happy it is possible to negotiate over the phone. Have a figure in mind that you're not prepared to slip below. Remember to disregard the interest until you file at court. Your offer is not bad though!

    Thanks Lou, will look through and see what i can find.

    I just dont know how they got to that figure and why they dont just give me back what i have incurred over the years, i have stuck to thier time scale not mine thus not taken them to court thus saving them over £700.00 but yet they still want to keep nearly 400.00 of my money

    Yes it is frustrating, unfortunately HSBC play the delaying game to the bitter end. I would definitely make a call and say that you thank them for their offer but unless they can increase it to £2000 (or whatever figure) you will have to reject it. If you are courteous and get a decent person on the end of the phone you might well come up trumps.

    Alternatively, take it to court and claim the whole lot. Just remember you have to wait months longer for your money. That's the decider for me really. I'm having to wait until July before I get to court/get paid.

    I have been trying to speak to someone since my offer dated 19/04/07, keep getting told they will ring back but they havent, this has happened 4 times now. so have accepted as partial payment via messaging/online banking but still no call, no nothing...............

    Hello everyone just wanted some help i have taken HSBC to court they acknowledged the claim iving them until the 8th of May be my working out, this is tuesday and as yet i have no post with an offer or defense what do i do next do i wait til midnight on tuesday and eneter a judgment by default and if so does the MC website show you easily how to do this?

    i am asking for 3587.41 which includes intrest what is really annoying is they have charged me £300 in charges whilst waiting for them to come back to me grr!

    Hi, they will probably file a defence at the last minute, which is very frustrating. It is easy to apply for judgement if they don't, so don't worry. You will be applying for judgement forthwith which means you'll be paid out quick. If they do file a defence, you will get a Notice of Transfer of Proceedings to Local Court - again you need do nothing until you hear from your local court. Fingers crossed no defence appears...

    i`ve sent all letters and they have tried to stall on each letter. taken them to court and today recieved a letter stating they are defending claim. YET ANOTHER STALLING TACTIC . just keep to your timescale not theirs.

    I used the template only changing the account details etc.

    I have finally had a call from HSBC today to discuss thier offer

    Claim Started 01/03/07 for: 2173.48 + interest = £2765.91

    Original Offer 19/04/07: £1800.00

    Accepted Offer 04/05/07: £2173.48

    They have finally agreed to reimburse all of my bank charges so will be happy to accept and not persue interest through the court.

    Just waiting for the new offer letter to arrive and then comes my money :j :j :j :j

    I found messaging through online banking very helpful but did state that i did not want any fob off messages but an offer
