    I used the template and asked for a statemnt of charges going back to when the account was opened 3 years ago (this is for work not me).

    Today I got 26 envelopes with 26 months statements in and more to follow.

    Is this normal? I expected a statement of charges only, was I wrong?

    If so I imagine I must calculate all the charges applied to the account for bad chqs and overdraft fees?

    i have only paid £120 to MCOL, I believe it is at the courts discretion as to whether to charge a further fee or not but I am unsure.

    So your defence is exactly the same then huh?

    Must be a standard piece then if it is, that makes me feel a little better, in that its not an individual thing.

    Do i now need to call the Court or do i just wait?

    Louloujs, I wonder if you can help me, or anyone who might know? I've also had my claim transferred from MCOL to my local court, just waiting to hear from my court. What did you mean by court bundle, is that the allocations questionnaire I keep reading about? Do you normally received the 'court bundle' when you get your transfer notice from MCOL or from the court it's been transferred to?

    Also, not meaning to come across daft, I've been doing the sums to work out my interest up to now. The total on the date I submitted my claim was £2076 with interest, I've multiplied that by 0.0026 then multiplied that total by the amount of days since then (42), amounting to approx £226 more interest up to today. I wondered what you thought the chances are of claiming for the interest in between the date my claim was submitted and the date I receive an offer/go to court.

    Firstly, you'll get your Notice of Transfer of Proceedings to Local Court. You may or may not receive the AQ which you complete and send with £100 fee (see the help thread for completing it):

    After this you'll get a notice from the court giving you 21 days to file your 'bundle' which is basically copies of absolutely everything with a covering clarifying statement - again the help thread above will help you. Judging by the success stories, you will receive your offer a week before the court date...

    With regard to the interest. I think you may need to move our decimal point (or I do mine). That interest should amount to £22.60 not £226. Once you're in the court system, you are entitled to that interest up until the date of judgement/offer from bank. So you will get it! Good luck

    I am currently trying to claim from hsbc, has anybody sent the first letter then waited eight weeks for a response, if so was an offer made? and how did you get on?

    Don't wait 8 weeks for a response. In your letter, you should demand a response within 14 days. If you do not get a response in YOUR timeframe (not theirs) move on to the next stage.
    The 8 weeks is just a delaying tactic by the bank to try and put you off.

    Hey all have been reading these threads with much interest. I have a query about my claim as I am unsure where I stand legally here.

    I initially claimed PLUS interest but then realised I am not entitled to this, so I wrote my final letter to HSBC threatening legal action but claiming WITHOUT interest. They did not respond, so I am now going to court for the full claim including interest plus court costs.

    They have already said they will defend the claim but have now offered me my claim without interest or the court costs. I dont believe this is acceptable, but I am concerned that I INITIALLY requested interest and this could go against me in court, even though my final letter to them was WITHOUT interest.

    Incidently they have also rejected a very small amount of my claim as it is apparently over 6 years from the date of my initial claim, although had they responded in a timely fashion it woul not have been!

    I keep reading the same comment recently from HSBC that they wont pay X amount as not withing 6 years,
    I think this is the latest in a long line of dirty tricks as I was under the impression if you have the statements then you can claim regardless of within 6 years or not

    Also , its pretty scandalous as the reason claims arn't within 6 years is because they are stringing them out
