    Hi Everyone,

    Just wondering if anyone out there is off to court in Newcastle. HSBC have just defended yesterday (cut of was tomorrow, swine's!) and looks like I'll be hanging around this thread for a while......

    Not even vaguely worried - becoming an old hand at this reclaiming malarky but can't see anyone else from "up north" on their way to the county court.

    I'm from "down south" but am in the same position as you, HSBC defended on 26th April and the claim has been transferred to my local court, so I am now waiting for a court hearing date. I only sent my first letter off reclaiming my charges on 21st Feb but this seems to have been going on forever. Probably because I am checking the mat everyday hoping to receive a decent 'goodwill gesture'.

    Glad to be able to do this in the first place though obviously.

    Take a look at the last three pages - i've put a bit in about whether to go to court or wait the 8 weeks. In a nutshell, you'll wait a lot longer (months...) but you'll get your interest and costs back with MCOL. If you need your money quicker, do the letters but wait the 8 weeks...

  • grr, just phoned the missus, still no letter, if this truly was sent on friday then i believe it may be arriving via a limping pigeon with one eye...

    anyone else who was promised that the letter was sent friday had any luck yet?

    I just spoke to some guy from HSBC who is trying to get some info/a callback from their legal department, since i have started the MCOL process (15 days in now).

    Am I right in saying that since my starting the MCOL process, they no longer are obliged legally to give me a full response within the 8 weeks of my claim letter?

    thats what the guy just told me...

    Serems pretty slack - mine was pos marked on the 30th - 6:45pm and it arrived tuesday morning...

    - 2nd letter requesting money sent

    - Standard Reply
    - 23/04/07 MCOL claim started
    - 27/04/07 - Offer received & rejected
    - 28/04/07 - Letter fromA&L Solicitors stating intention to defend

    HSBC - 1st letter requesting money sent 07/03
    - Standard Reply

    - 2nd letter requesting money sent 21/03
    - 01/05 Received Offer for good amount

    Send your second letter on your planned date.. give it 2 weeks and call them. Their response will be "We are looking into this, we are allowed 8 weeks (from the date of them receiving the initial letter) blah blah blah"

    This is where you make your decision, do you wait the 8 weeks (they do seem to be sending out offer letters at the end of the 8 weeks, mine should be hitting the mat any day now.... grr) or take them to court?

    If you have a good read through this thread (especially the more recent posts over the last few weeks) you will be able to get a better idea of what decision will be best for you.

    Hi There, Gone throught the process as far as informing HSBC I intend to take them to court, 7th May being the deadline, and fully expect to start the court process of my £9922 claim! My question if anyone can kindly help me with, is that it's over the small claims of £5k, what have i to pay & can i do it in 2 claims? I'm confused, I must confess! I do intend to take it all the way, as I remember how desperate I was being in debt to the point of trying to commit suicide at the time, and these bank charges just made it impossible for me to help myself out of debt! I'm ok now, but I think their charges are disgraceful. Thanks in advance

    well I was in the same boat, but just got 550 from HSBC after bout 6 weeks
    they do state that charges are not lwafull but looking at all post not one has actully gone thru with actually defending in court,just send the letters from this site and they will sort in the end but will play for time

    HSBC letter did arrive today (post was late).. i requested over £1800 inc interest. They offered £1050, missus said they stated int he letter a list of things they think I couldnt claim back (overdraft limit fees etc.) .. im pretty sure I can.

    The wife is typing and e-mailing me the letter shortly so I will post and ask for advice soon. But in the meanwhile, I guess i have to make the choice between taking the 1k or taking it to court... !!!!!!.. annoying this is I said to myself that anything over £1200 I would accept. :(
