I just spoke to some guy from HSBC who is trying to get some info/a callback from their legal department, since i have started the MCOL process (15 days in now).
Am I right in saying that since my starting the MCOL process, they no longer are obliged legally to give me a full response within the 8 weeks of my claim letter?
thats what the guy just told me...
He's right, once you're in the court system, forget the 8 week response. You've superseded that process now so expect your claim to be acknowledged online by HSBC anyday, then you'll eventually get transferred to your local court and get a date... But, you're entitled to interest until the date of judgement...Lou0 -

It IS a very strange feeling to have someone offer to give you a thousand pound, yet be p!*sed off with it.
I think its because i was planning on paying off my managed loan, catching up on another loan, and having a few hundred quid to put to one side to help out in the near future. Witht he 1k I will be able to clear my managed loan and make an extra loan payment but left with little else.moo0 -

My claim is 2636 , and as much as it will be a pain in the !!!! to carry on indefientaly , I wont settle for less than £1900.

I know what you mean about being disappointed. I'd spent mine before i received it - and i've claimed loads. I just used it to pay off credit cards and 2 months on, i'm behind again and desperately need the HSBC money to hand over the the cards for this and next month. It's a vicious circle that I hate with a vengeance.
Double check the charges you're claiming and if there's any discrepancy ring and negotiate. From earlier on in this thread there are plenty of people who have done deals over the phone. Also make sure that they're not offering you the difference between the charges and the £12 OFT suggested fees. That is not on and you can refuse their offer if that's the case. Just remember by going off to court you're in for a long wait...
As you'll see from my business account offer below, sometimes you have to take the money due to time and financial constraints, do what's right for you. You've gained money that you didn't have before remember.Lou0 -
I filed my court claim at the start of April, my claim got acknowledged so HSBC have until May 7th to file judgement.... however I got a letter from them today in regards to my letter asking to be refunded without the interest..... they have made me an offer based on the amount I originally asked for (so without court fees etc...) I don't know what to do now... I don't know if I can accept the offer because then what would happen to my court claim iykwim??
I originally asked for £570 and they have offered me £484.50 but since taking it to court it's now over £700 because of charges and interest...
I hope someone can help.... thanks

Hi Laura
You have a minor dilemma with regard to the interest, but the court fee must be paid by HSBC. If I were you, I'd be on the phone explaining that the case has proceeded to court, so you'd like your court fee back but are willing to forego the interest (or negotiate). However, HSBC will quite often forget the offers and negotiations once court action has commenced, so you might be lucky and get your net amount and court fee now. Otherwise, wait and see the court thing through if you want your interest back too.Lou0 -

Yeah, everything I claimed is allowed, mostly built up from abusing my cheque guarantee card, bounced DD's and going over overdraft limit. So I feel confident that I would be due a lot more.
They also stated in the letter that they wouldn't pay interest on the money.. lol. Still waiting for the full details of the letter from the wife but that is pretty much the gist of it.
I was planning on asking if its worth trying to verbally "haggle" over the offer on the phone, and if this is likely to be successfull, what arguments can be put forward to persuade etc.moo0 -

My 8 weeks expired on Monday but been told
Offer generated fri and will go out
then phoned next day (tue)
Offer generated Sat and will go out
then phoned today
Offer not generated due to glitch in System !!!!!! ? but they are working on it , she is apparently gonna go straight to her manager who is near her and tell him about it, given number and he will call hopefully in 48 hours.....but could be longer
What do you make of that ? any one ever had a call back ? is it delaying tatics ? when does the point come I need to raise MCOL ?

I would definitely get on the phone, you could say that they've repaid other people what they're denying you so they've set a precedent. Your argument is that by settling now they're not having to pay interest and court fees. If there is limited room for negotiation just keep a figure in mind that you're determined not to drop below.
