    If it puts your mind at rest at all, I'm in a similar position. HSBC entered a defence on the 12th April and I've been sent a 'Notice of Transfer of Proceedings' (also to Hammersmith). Nothing has arrived since then.

    I don't think they're sending out Allocation Questionnaires (my letter said so anyway) so you should receive a court date any day now.

    Fellow poster loulou's date was given as 13th July but at a different court so hopefully Hammersmith is more efficient.

    Presumably your parachute account won't take too long though?

    hey guys

    HSBC have until 4th may - that is 8 weeks since my initial claim, and I was under the impression I would receive something from them at this time... any ideas?

    I filed MCOL 2 weeks + 4 days ago ago, and they acknowledged the day before the served date (26th). Could they still send me an offer? If they do, is it possible to retract the MCOL? Am i now stuck in it till the end?

    I just called HSBC on 0800881155 to ask this, and their guy advised me that he would have a word with the Legal Team and call me back tomorrow?

    Any advice would be greatly appreciated...

    Don't cancel the MCOL until you actually have the money!

    i wont be cancelling anything till i am holding that £1200 in my hands! lol... shame i just cant ditch HSBC afterwards... i have a stupid managed loan hanging over my head...

    Hi everybody!

    Let me start by saying that i have been reading this website and forum for several days now, and found it very helpful and supporting in also having a go at reclaiming by unlawful bank charges back!

    I am a bit confused though about the 8-week rule that HSBC applies. I have sent my original letter reclaiming £ 775 back last week. Given that they have 14 days to respond, i will sent my 2nd letter next week if no reply from HSBC untill then.

    As advised on this website, in my 2nd letter i should state that i have not received a reply/satisfactory answer, and give them another 14 days before i start court proceedings.

    So my question is, if the 14 days after my 2nd letter has been sent are over (so 4 weeks after 1st letter), should i start the court proceedings, or get on the phone to them, and give the 8-weeks rule a chance??

    So in other words, would i have more chance in getting my money from HSBC by stick to what i write, and start court proceedings, or wait up untill 8 weeks to give them a chance to settle it ouside court?

  • hi all,
    I sent off my first letter a week and a half ago and recieved my reply today. HSBC have said that they have recieved my letter and are looking into the matter and will contact me when they have looked into it. They have not stated a time in which they will respond yet didnt say i couldn't claim. I'm a bit confused as i wasnt expecting this. Has anyone experienced this? what do i do next?
