this is classic. Told a different thing everyday
My 8 weeks expired on Monday but been told
Offer generated fri and will go out
then phoned next day (tue)
Offer generated Sat and will go out
then phoned today
Offer not generated due to glitch in System !!!!!! ? but they are working on it , she is apparently gonna go straight to her manager who is near her and tell him about it, given number and he will call hopefully in 48 hours.....but could be longer
What do you make of that ? any one ever had a call back ? is it delaying tatics ? when does the point come I need to raise MCOL ?
I'm not even claiming interest , woulda thought be in there interests to not let me MCOL
Can only speak from experience with MCOL. I filed on 9th March and have one court date of 13th July - THAT'S 4 MONTHS! The other court claim hasn't even given me a date yet... Remember you will get an offer and with it an opportunity to negotiate if it's not what you want. The choice is yours but I would hang in there a bit longer.Lou0 -
I just phoned HSBC and they told me it is now out of their hands and the legal team is now dealing with it... I asked if there was a number I could contact them on and they said I will have to wait for them to contact me ARGH!! so I guess I will have to wait and see if they file a defence before Monday??
Problem is I'm moving house on May 14th so don't have long left to get it sorted really... I'm guessing they will file a defence the day before I can file judgement... thats what they seem to be doing anywayThanks to everyone that posts :T:money:

thats what ive been told when ive called them. The guy on the phone advised me that he would do his best to get through to the 'legal team' today and call me back to advise me either way. He advised that neither he nor the rest of his team can do anything regards offering anything etc... other than ask their legal peoples.
im pretty damned prepared to go to court against them (because would i be right in saying that nobody has lost yet? - in fact if thts true, wouldnt i make mre money being the first person that the banks turn up to defend against? - im pretty sure they wouldnt make an example of me and my £1200 because some guys are quite rightfully claiming back tens of thousands...)

I have just been reading through the forum and i keep seeing people use the term standard letter, I myself are trying to claim back charges and after i had sent my letter stating the amounts, i received a letter from them saying that they are looking in to it is this a standard letter and should move on to stage two after 14 days?0

yes. Ive been told time and time again to stick to the timeline in the MSExpert article. Send the letters 14 days after... tell them you are not satisfied with the response.
There is a variation now though, from what I have been reading on the threads. Some people are now waiting for the 8 weeks to expire to see if they get an offer anywhere near the amount they would accept. This is entirely up to you. I stuck to the timeline, and am now halfway through the 28 days that HSBC have to enter a defence to my MCOL. This route will take longer, but it will ensure that I get the full amount plus interest plus court fees. I beleive that HSBC may still make an offer, but I am going for the full amount (being a student)!
Now that I am taking the legal action, they do not have to reply within the 8 weeks they tell you.

well, just got my offer letter today, and they received my first letter on the 5th March, so pretty much 8 weeks. Just still pondering wether to argue for more or take the offer.. hmmmmoo0 -
theres only one thing that is scaring me about doing this and that is the fact i have a £10000 loan from hsbc and if they were to close my account i might be in a bit of trouble as i think i would be very lucky if i was able to get another loan as my credit ratings are completely shot to pieces, due to all the snow balling bank charges in the first place0
