    I too am a little worried about this issue. I currently have a managed loan outstanding with them for around £4000. Would or could this be at all affected?

    I don't see how they could "close" your loan.. they can't just tell you to pay all the money back at once.. and at the end of the day, that loan is making them money with the interest you are paying. It wouldn't make sense financially for the bank to be willing to do this, in my opinion anyway.

    Hello everyone, I am a long time viewer of this site but first time poster.

    My other half is always struggling week in and week out with her money and can never seem to get out of her overdraft, obviously the charges never help.

    She has asked me to help see if we can reclaim charges from HSBC, but my concerns are that she is still in her overdraft and she also has a loan with HSBC.

    How would these factors affect her potential claims?

    Also, has anyone else had any experience of claiming from HSBC and would like to share the thoughts and experiences?

    Yes currently in the process, there has been no correspondance at all from them with regards to the letters i have sent. So i have issued them with a court warning via the moneyclaim site. They have just defended it, stating the are disputing the money owed, so i will now be issued with a court hearing date, not sure what the outcome will be but i beleive they owe me the money so i am going for it.

    Do not worry. Your loan was provided to you with terms and conditions attached that they will be unable to vary on the grounds that you are claiming bank charges for another account. It is highly unlikely that they will even ask you to close the account your claiming on. As long as you make your repayments to your loan on time, you are fulfilling your agreement with them.

    Also, with regard to your question about the letters - stick with the letter templates and your timescales that you're quoting. There isn't a variation on these letters; the only difference is that with HSBC you will be written to saying that they will conclude their investigations into your claim within 8 weeks. You carry on with your letters and court action if you wish. Remember that with court action you will be able to claim interest and your court fees but will undoubtedly have to wait much longer as they are likely to defend and wait for your court date. It is unlikely they will attend court and you are likely to get your settlement a couple of days before - unless the judges become so p'd off that they cancel the hearing and award you judgement anyway.

    I have been through all the stages against HSBC, they have defended the claim, so i am now waiting for a court date. Feeling abit weary of this part, does anybody know if its just a stalling tactic or should i dust my suit down.

    My claim total £5K including interest, for overdraft charges, returns. Standard stuff i thought

    Yes, it's really tedious but there's nothing you can do except wait for your court date. The only thing you can do to relieve the monotony of not getting a transfer to local court notice or court date is to ring your local court and ask them how busy they are. I've got to wait until mid July for mine but i'm relatively happy in the knowledge that i'll have money and interest and costs back just before then...

    Letter 1: 01/03/07
    Letter 2: 14/03/07
    Numerous faxes and telephone calls

    Response: 19/04/07 Offering £1800.00

    I have not filed with MCOL and am waiting for HSBC to ring back to discuss this offer.

    Will update as soon as i have some news

    cheers for the advice, i'll try and get some dates from my local court in the meantime. do i just book a court date with them and inform HSBC via a letter or will the court do that for me?

    Remember you are only entitled to interest when you are in the court system! Don't let the lack of interest influence you therefore!
