Hi, I stuck to my timescale (not the banks) and court filed in court. The court sent me a Notice that Acknowledgement has been filed and HSBC intend to defent all then claim. What happens next ? I tried to search the forum but can't see what I'm looking for. Also the 8 week bank timescale is up next week, so do you think I'll still get an offer or have I blown that out by going to court ?
Any help appreciated.
Thanks.0 -
Hi all. I have just lodged my case with mcol and was charged £80.00. Is this usual? I am claiming back just under £600.00 with the interest.0

Just called my local county court to find out what happening and they aid that HSBC didnt return their allocation questionaire and that I need to file a judgement, does this mean I win by default? I'll get you debts and your little dog too!!! :mad:And best of luck to all the other debt busters out there!!:beer:0

If they didn't file a defence within the 28 days (14 if they didn't acknowledge your claim) you can file a defence. If the court has said that you need to file a judgement, get down there, get the form and do it. Unusual for HSBC not to be on the ball with their paperwork, but you may have slipped through the net.
Getting the judgement sorted is easy. You just need the form, but do it soon so that HSBC don't ask for it to be set aside while they send their documents in in the mean time.Lou0 -

You need do nothing for now. You will get a Notice of Transfer of Proceedings (to your local court) and you may or may not have to complete an Allocation Questionnaire, depending on the court. I would think that your chances of getting the 8 week offer are pretty low now. I filed at court and have not had the offer (8 weeks were up ages ago) and i can't recall anyone on this thread receiving an offer once court action has started. It would appear we move onto the 'let them wait even longer' pile...Lou0 -
Hello Peeps
I have today received my court date. Friday 13th July. lovely. Can't believe i've got to wait another 2 1/2 months for my money back but even more determined to get every penny of interest up until then. They are clearly hanging onto their money until the bitter end.
For any of those HSBC bods who are sure to be following these threads - IT MAKES NO DIFFERENCE HOW LONG WE WAIT. WE ARE HAPPY IN THE KNOWLEDGE THAT YOU'LL BE DIPPING INTO YOUR POCKETS BEFORE LONG.
Going to explore the threads to see what to put in my court bundle...Lou0 -
8 weeks up tomorrow, will ring them and see if offer on way if nothing in post , if not then mcol. £2636.
Looking forward to it , hope its positive news
haha, mine too, to the day..
Rang them 10 minutes ago, offer letter sent (2nd class) on friday, so should get it tomorrow, see what they've got.
Luckilly I am "relatively" ok financially for the minute, so if its offering significantly below my requested amount, I will still push to small claims I think, will [post tomorrow to update!
