    Yes, in retrospect perhaps I should have waited, but I used my MCOL fee from other 'winnings' which made it easier and made me feel like I was doing something.

    But I actually wrote my preliminary 14 day letter on 12 February so you can see how long i've waited so far - i could even get a June court date so I've got a way to go.

    My advice would really be to wait the 8 weeks as HSBC are without doubt the one back that is hanging onto its money for as long as possible. It didn't get those billions in profits for giving out money...

    I dont know the answer but I will say you WILL find the answer if you look around the forums.
    I would also say dont worry about that too much yet , I am claiming 2636 without interest and week 8 is up on Monday so you have plenty of time to get clued up.
    If no offer then I will ring up on Monday and get offer , If they cant do this then I will file MCOL straight away !

  • What address should I put for HSBC on my MCOL form - head office or branch? I sent the original letters to branch. Also, can I claim interest via MCOL, although I did not claim interest in original letters?

    Any help would be much appreciated

    Darkman - keep writing to HSBC direct. The solicitor, the lovely Mr DG will write from HSBC anyhow...

    L - take a look at the help thread here:

    If you look at post 3 (if I recall correctly) it will give you the advice to issue MCOL to head office (although it is in order to claim from Local Branch - where you can then take pleasure in sending the bailiffs as one lady did to HSBC). You can claim interest. In the particulars of claim text (also on that thread) you must outline what interest you're claiming and remember to tick the box on the claim form to confirm that you are claiming interest - up until the date of issue and until payout day...

    Just wondering if anyone has tried and failed to reclaim their bank charges?

    I'm a little concernd as HSBC have advised they intend to defend the case against them in court. I'm aware that this is highly unlikely to happen but if it does will it be in my local court? Or will it mean a trip to Northampton?

    Started claim for just over 2K at the end of Jan. They are defending the case and so i am expecting a better offer than the first! Reading through a pile of old posts I cant find an answer to the following question.

    HSBC have added charges to my account since this whole thing started. How do I communicate to them that I want this money back as well? Obviously writing to them has little effect as its just an endless delaying tactic from them. I cant increase the MCOL amount as its now been refered to court?

    BTW, can we register defaults and poor payment history on HSBC's credit rating?

    The issue with HSBC seems to be that you are extremely likely to get most of your claim after 8 weeks, but to get the full amount you have to go through the court process (MCOL or actual small claims). You have to decide what you are willing to accept.

    I claimed about £1900 including excess overdraft interest etc, which they won't entertain and after just over 7 weeks they have offered my £1700, it seems pointless to wait another 6 weeks or more to get a few hundred because this is the difference between a holiday for my family this year and not. So I am taking the money, though I would rather take them to court.

    Ian - you're right, you can't add charges that you've incurred once you've started the claim - only the additional interest. I'm in the same boat really. All we can do is wait to get paid for the current claim and then start all over again - which might well end up with them asking us to take our business elsewhere...

    If only we could register defaults against HSBC! They are one of, if not the worst bank to settle in terms of time. Unfortunately, they're the provider and we're the customer so we can't log their poor payment record, but we can refer our problems to the Financial Ombudsman collectively who can slap wrists. On the other hand, we're hitting them where it hurts right now, in their pockets.
