Go for the lot, HSBC have got until May 5th to enter a defence for me on two weperate accounts and i want all my money back - £1700ish
Dont settle for a lower amount, its just a tactic to drag it out!
If I indicate to them that I am rejecting their offer, how would that affect the MCOL claim I have? The warrant expires a week on Saturday (their 4 weeks from having the claim served and them acknowledging it). If I refuse it, can I still make a claim for the payment on that day, or would I have to then wait for a court date?
How long could they string this out for? We wouldn't mind holding out for the amount if it would be over in a few weeks, but if it would be months, then we couldn't afford to.0 -
I have been with the hsbc bank for about 20 years now and they have been very good to me over the years. I added my partner to the accountbout 10 years ago and then over about 3 years up untill now we have gone over drawn. It was a variety of reason why we went over drawn. We have an overdraft limit of £600 and we got a flexi loan out with them a couple of years ago which is £1600.
At the moment we only have a couple of direct debits coming out of this account I don't mind in closing these accounts but we can't afford to pay these debts off.
We are not paying anything off these each month on these debts only about £10 each.
I have kept most of my statements and I am thinking of claiming my charges back. I have added up one years worth of statments and it comes to £666.
So I don't know how much it will come to for the 6 years.
I need a bit of advice on how easy it is claiming back from HSBC and I would like to know if they have closed accounts down as we can't afford to pay back the debt any advice you help me a lot before I send them the letter.cross stitch cafe #90 UFO's 6 to finish in 2013, and loads of new kits to boot

I wrote to HSBC following Martin's instructions asking for an itemisation of charges across 3 seperate accounts and enclosing a £10 for each. They returned the cheques and said they did not have the facility to provide this and would supply hard copy statements.
A few days later, and for several days following, I arrived home from work barely able to open the front door due to the sheer number of these statements! I wonder if it is a tactic on their behalf to put us off re-claiming due to the time it takes to order and manually search the charges?
I would also question how this policy fits with their objective to be environmentally friendly in recommending customers opt for online statements to save paper = trees!!!! Maybe I'm just an old cynic but maybe this is just a pr exercise.0 -

UPDATE
I telephoned the court today. The very nice lady there told me that HSBC Solicitors have not returned their defense papers/forms to the bank as of today. Should have been returned within 28 days apparently. As it has been over 28 days since I returned my AQ she was suprised that DG had not returned theirs. The files would now be referred to the judge for his decision in the banks absence and with the absence of their paperwork.
She said it should take 10 days, so I will let you know what happens next.

Hi Guys been reading and preparing for a week now, and have finally drawn up a list of charges for two HSBC accounts totalling up to £2,386.76 and ready to get it back, by the way that’s without any interest yet. Looking to do the same to credit cards, and hope they close my account don’t mind have 4 others, which have never used:) I knew they would come in handy one day!
I have one Q, I understand that they are writing via solicitors what’s the best way forward if this comes up?0 -
I wouldn't be nervous - from what I've been reading nobody has ever reached the actual court stage with HSBC - they tend to settle at latest a few days before the court date. By the sounds of it you may get the money even sooner.0

Same boat for me. Be prepared for a long wait. They seem to be dragging it out for as long as possible before sending an offer out to you or requesting a list of charges. If the latter happens then fax them the list - it's just another delaying tactic.
From what I've been reading on this board HSBC's general tactic seems to be to just try to drag it out as long as possible.0 -

Sent my 1st letter to HSBC last week by registered post to claim back my charges over 6 years. It was signed for on the 19th April. Obviously no reply yet but I have a question, so if someone can help that'd be great.
The advice on the site seems to be "stick to your own timetable" i.e. 1st letter - wait 14 days - 2nd letter - wait 14 days - take the bank to court.
HSBC on the otherhand seem to be telling everyone to wait 8 weeks from logging the complaint (as I said, I've no reply yet so this is based on what I've read here).
I realise 8 weeks is the time the Financial Ombudsman Service says you have to wait before bringing the complaint to them if the bank can't deal with it in a satisfactory way but, now be honest, how many of us are intending to make complaints to the FOS? I think we're heading to court not mediation!
In that case, do we legaly have to wait 8 weeks or can we just go along with our timetable and ignore HSBC. As far as I'm aware the courts say you just have to give them a 'reasonable' amount of time.
Isn't 4 weeks a reasonable amount of time?
So then, my question to all of you. Do we have to wait 8 weeks?

Having read many of the threads on here, it seems that whatever you do the bank sticks to the 8 weeks and then makes some kind offer. It is up to you as to whether you stick to your own timetable (4 weeks) or allow them the 8 before starting the court claim process. Personally I don't have a spare £120 so am waiting to see what I am offered before continuing. That 8 weeks is up this week (letter from them dated 7th March).Julie

From what the lady at the Court was saying, the Courts [well my local one anyway] are getting very p****d off with the banks. They are dragging things out for as long as possible and then either settling a couple of days before the court date or not bothering turning up if it actually does get to court.
I wonder which Judge is going to 'snap' first
