    I am claiming £680.50 from HSBC and as it went to MCOL, there was a £80 court charge which I added onto the sum being claimed, making a total of £760.50.

    I have received an offer from HSBC of £599, which I have to say I am a little disappointed with. The way they have phrased the letter has got me thinking whether it's worth pursuing...
    In circumstances where you would like us to make a payment from your account that would, if met by us, lead to your account going overdrawn or over an agreed overdraft limit, we have to consider whether to make this payment. A fee is payable for this service provided by the bank, details of which are set out in our published price list. The circumstances in which the fee will apply are set out in our Personal Banking terms and conditions, which you have already received. If your claim for refund proceeded to Court, we therefore believe that we would successfully resist any legal challenge in relation to these fees.

    We are, however, mindful of the management time and irrecoverable legal costs that may be incurred in relation to such a claim. For those commercial reasons alone, and without any admission of liability whatsoever, we are prepared to make a payment to you for the sum of £599.00 in full and final settlement of the matter. This represents our offer in repsect of the charges applied up to and including 23 April 2007

    Is this the standard blurb they send out to try and get you to accept a lower account? Has anyone rejected an offer like this and won?
    We're a bit hard-up at the moment, so we're tempted to accept just to get the money, but it leaves a bitter taste that they're taking £160 off the claim.

    Any advice would be appreciated.

    Go for the lot, HSBC have got until May 5th to enter a defence for me on two weperate accounts and i want all my money back - £1700ish

    Dont settle for a lower amount, its just a tactic to drag it out!

    I've been reading post's in here for age's, but only joined today, I could use some help/advice. This is my story so far:

    01/03/07 Letter sent to HSBC service quality team in Leeds requesting full refund of 6 year's charges totalling £1523.26 (without interest).

    08/03/07 Ive found out from calls to the SQT (service quality team) that this is when my 'complaint' as they call it, was logged on thier system

    14/03/07 Letter received from the now quite famous Mr. Colin Langdale, explaining things are been looked into and a full response would be given when investigations are complete (standard letter).

    Now its quite clear from reading through 100's if not 1000's of posts that HSBC are dealing with these 'complaints'/claims, but, are sticking to thier 8 week timetable which they say they are entitled to.

    So rather than sending a LBA (Letter Before Action) and spending money I havn't got on MCOL (Money Claim On Line) and it then getting dragged on alot longer than 8 weeks, I've decided to wait, and give them thier 8 weeks, at least then I can say I've given them a fair chance to resolve the matter.

    The 8 weeks since my 'complaint' was logged by them is nearly up, this coming wednesday 02/05/07, and have been told on the phone by the SQT that they will 'respond' within thier 8 week deadline.

    My concern is that because I havn't sent an LBA that they will send a really low offer or at worst refuse to refund!

    My question's are, should I wait a few more days till the end of the deadline and see if/what they offer? Or should I send off a LBA now? Or Should I send a LBA when I get a low offer/no offer? Help! I think I might have messed up big! :eek:

    Hi Rob,

    It lokos like you are a day ahead of me - they 'logged' me on the 9th and after calling frequently I called again today and they told me i should have an offer letter by the end of next week.

    I held off cos i couldn't really afford MCOL. I'm still wary that they may make a really low offer, but if they do then i'll go to MCOL but it looks like they've been making reasonable offers.

    Basically, i'd hold out if i were you... sounds like you're in the same boat as me and it may be worth seeing what they come up with first.

  • Hi Can anyone help please? Am about to start a claim on MCOL. Am trying to claim back charges on 2 accounts from HSBC, one joint and one sole. Is it possible to do under one claim, therefore only paying the fee once? Or do you have to file two separate claims? Any advise would be great!

    we accepted £550 just because really couldn't afforD MCOL adn time taken for this .
    if you got the guts then go for the lot!

    well here goes!!!
    sent first letter claiming £704 plus 184 interest on 12th march
    got a few letters from Colin langdale requesting that i send list of charges!!
    then a few days later got letter saying that they will send me statements as I had not requested them and they would send them to me!!

    got about 40 envelopes with statements

    LBA sent 26th March

    sent secure message via on line banking they confirm they have rec'd letter and it is being dealt with and they will let me know
    sent emessage every day since

    we were starting to get a bit like giving up at this point
    as some people on here seemed to be having tha same problem and kept getting same response from bank but after getting help from people on here decided to keep going

    20th april we rec'd letter offering £550. which we have accepted
    ( they will not refund £75 which we have already had back ( well it was worth a try)
    and also charges for next month also
    and sorted in 6 weeks without MCOL

    just wanted to thank everyone that gave me advice and also wish everyone else luck
    ( will post next weeek to see if we actually get the money)!"!

    I am wondering if anyone can offer any advice.

    I wrote to HSBC approx 4 weeks ago requesting bank charges back, received the old "we are looking into it, give us 8 weeks" reply from Colin Langdale. I gave them 2 weeks and sent the next letter threatening court, requesting an offer within 14 days or I would start court proceedings.

    Tomorrow will be 14 days since that letter and I have had no response. However, I was reading through some of the "success stories" on this site and the trend seems to be that people who wait the 8 week period that HSBC suggest, are getting good offers without having to continue with court proceedings.

    Basically, should i file my claim tomorrow, or should I wait a few more weeks for them to give me an offer?? Thank you to anyone who can help.
  • HI all,
    I'm getting a bit nervous and so I wanted to check I haven't missed anything.

    My court transfer documents arrived for my case against HSBC on thursday the 12th of April saying in my case the AQ had been dispensed with and since then I've been waiting for something else to happen.

    I asumed i'd have recieved something by now, either a court date from my local court or a letter from HSBC's solicitors as seems to be the norm, however as yet nothing has arrived. It seems a lot of people are at the same stage as me so I was wondering if someone could tell me what should be happening next and when I should be expecting to recieve something so I can move forward.

    Also i've scanned the transfer documents but I doesnt seem to mention signing or returning anything, should I have. Is there anything I can do or do I just need to keep on waiting?

  • Thanks eyeball, I will wait and see what drops through the letterbox next week, i'll post on here and let you know as soon as i hear anything.
