    If you look back a few posts I sent a reply to Rob who was in the same position as you, which is the same position as me. He is dated from the 8th march, me from the 9th.

    If you dont have the cash to take them straight to court then you might as well wait. by the time you have issued MCOL they'll have sent you a letter.

    Just wait a few days if i were you and see what happens, me and Rob are, join the club!!

    You're wondering about whether to wait right?
    THeres a few of us who are waiting, but our 8 weeks are up in the next week or so. It looks like they settle quite well after 8 weeks, but its not guaranteed. If you can't afford MCOL for a while then i'd wait, but really its up to you. Maybe see what happens with me and a couple of others who's 8 weeks should be up soon and if it looks like they're not refunding much then take them straight to MCOL.

    Yeah I do have enough money for MCOL but wasn't sure whether it would be worth the hassle/risk when I might just get an offer through the post? Or is it the case that with MCOL I really don't have anything to lose by going ahead with it, and am likely to get my money sooner?

    HI all,
    I'm getting a bit nervous and so I wanted to check I haven't missed anything.

    My court transfer documents arrived for my case against HSBC on thursday the 12th of April saying in my case the AQ had been dispensed with and since then I've been waiting for something else to happen.

    I asumed i'd have recieved something by now, either a court date from my local court or a letter from HSBC's solicitors as seems to be the norm, however as yet nothing has arrived. It seems a lot of people are at the same stage as me so I was wondering if someone could tell me what should be happening next and when I should be expecting to recieve something so I can move forward.

    Also i've scanned the transfer documents but I doesnt seem to mention signing or returning anything, should I have. Is there anything I can do or do I just need to keep on waiting?

    J - You are not likely to get your money any sooner with MCOL, the only benefit if you can hang on is that you'll get your interest. You will receive an offer within their 8 week schedule and by all accounts if it isn't what you're asking for (don't forget you're not entitled to interest before court claim), you'll have a number to ring and you would be advised to negotiate. Many claims have been upped over the telephone.

    I haven't even had my court date yet and i started my claim more than 8 weeks ago.

    I'm in the same boat, basically the courts are busy, some more so than others, it's just a waiting game now. keep watching this thread though as you'll get a bit of reassurance that you're doing the right thing.

    If you get really twitchy, you could ring your local court and ask them how long it's likely to take before they get a date. You might want to say that it's with regard to bank charges reclaim as some courts are doing bulk court dates to save court time etc.

    This is where my confusion lies.

    I have always thought I would just follow the instructions on the site, which would mean i would now need to go through MCOL, and i would get my money either way in 2 weeks (plus 5 days).

    But like I say people do appear to be getting offers after 8 weeks, but I don't know if I can be bothered to wait another 4 weeks or not!!!
