The issue with HSBC seems to be that you are extremely likely to get most of your claim after 8 weeks, but to get the full amount you have to go through the court process (MCOL or actual small claims). You have to decide what you are willing to accept.
I claimed about £1900 including excess overdraft interest etc, which they won't entertain and after just over 7 weeks they have offered my £1700, it seems pointless to wait another 6 weeks or more to get a few hundred because this is the difference between a holiday for my family this year and not. So I am taking the money, though I would rather take them to court.
Julie - I can understand you accepting - you can only get the interest once you're into the claims process anyway. Before you accept, you could always ring to ask one more time for your £1900 before you accept - it has worked for a few people at the last minute.
On the other hand this is £1700 you wouldn't have thought of getting until a couple of months ago and a holiday is probably well needed. Going to court now will add a couple of months onto the process too...Lou0 -
Just wondering if anyone has tried and failed to reclaim their bank charges?
I'm a little concernd as HSBC have advised they intend to defend the case against them in court. I'm aware that this is highly unlikely to happen but if it does will it be in my local court? Or will it mean a trip to Northampton?

Quick question aimed at the moderators more than anything, as i need a bit of help!
Is there a quick link to the filling out of court allocation questionairres? Most of it is simple enough, but Section G 'Other Information' is causing me a little stress. I obviously want the judge to know that i have offered HSBC every oppertunity to cough up, and i am aware that they are playing for time in the hope i'll go away. I even phoned them this week, and was told an offer was sent on March 3rd (never recieved), and i would hear from the claims team within 48 hours (that was Tuesday, surprise surprise i didnt hear from them!).
Now, ive come this far, and i want to get the wording right. Certainly my areas of expertese lie elsewhere so is there a template somewhere? I was sure i saw one somewhere here before, but cant find it now! Got to get the AQ back by May 7th, so im in a hurry.

Hi and thanks for taking the time to read this post.
Basicly Ive asked hsbc for 610 pounds,i sent the letters using the templates on this site (fantastic by the way!!) my problem is that i gave hsbc 14 days to reply to my last letter or i said id go to court.
16 days passed and i didnt hear from them so i started court proceedings using moneyclaim,two days later i get an offer from the bank!!! 518 pounds,how do i or can i even cancel my claim with money claim?
also i originaly asked the bank for 610 which didnt include interest,now if it goes to court the total is nearer 850 including interest,obviously this is different figure to what i asked the bank for,
im now stuck and dont know what to do,also the bank has aknowledged and intends to fight my claim.
any help please cos ive opened up a box of headaches. moneyclaim isnt open on the weekend? help!!!0 -
Hi, recieved a letter from the courts this morning and I have no idea what it means but it looks ominous.
Recieved my transfer documents on the 12th of April transferring my case to Lmbeth county courts asHSBC had put in a defence, then heard nothing untill today when i have recieved a 'General Form of Judgement or Order'
It says the following:

Upon neither party attending
IT IS ORDERED THAT
1. Case transferred to London Mercantite court DX 44450 SRTAND

This sounds a littel to me like I have somehow missed my court case but i find it hard to believe it was held 6 days after i recoieved my transfer dpcuments.

As you have already issued a claim with mcol you are entitled to the full amount plus court fees and interest.
Better in your pocket than theirs!!!
Its up to you, but i would continue with mcol and get back ALL your money..... better in your pocket than theirs!!

no you havent done anything wrong!! Its your money and if they had refunded it to you within your timescale you wouldnt have filed on mcol . You are now entitled to receive the full amount plus mcol fees plus interest.
I doubt if you will have to go to court as HSBC tend to settle just before, im at about the same stage as you so will watch with interest, if you are worried read the HSBC thread as many have gone through this before you, and if you are worried about anything just ask, there are some great people on here who are always happy to help and advise. My advice is read up as much as you can then it doesnt seem so scary!!0 -
