    They are being a little cheeky with the dates as my barrister friend says they have 8 weeks to deal with it from the time they receive it...and that is the date they signed for it..not logged it into the system..so seems they are working from the 8th of March for me... bet you beat me to it!!!

    We'll see i guess.

    I spoke to them again today andstated the usual timescales ... my 6 weeks (which she said was likely) is up now, so i'm hoping to hear smething end of this week/start of nedxt. I'm going to call them again at the end of the week...

  • hi people.

    i am going through the motions with hsbc. i have just recieved a letter from the courts sayin it has been transfered to the small claims court and it will be heard on the 15th of may.
    i wasn't epecting them to take it this far. has anyone got any advice for me? will they take it all the way for £940?
  • I spoke to a lady today at the customer services number. HSBC acknowledged receiving my letter on 22nd March. She said currrently they are at the 2nd March....

    Well, they've had 2 letters and four and a bit weeks, so I'm registering with MCOL tomorrow when I get paid. Let you all know where it goes from there.

  • 1st April is my deadline with HSBC, I woudn't worry too much if they are planning on going to court.. if they do risk it and lose, it will only open the floodgates and cost them MUCH more (having to pay back full amounts rather than settle AND having to pay court fees)... i personally hope they DO go to court, get a precedent (spelling?) set and get something official in place...

    ok sent my 1st letter off to hsbc and they replied bk to me asking for a list of charges and dates of the charges which i sent with the 2nd letter they have till weds 25th to reply and then i should make a claim but unsure if wat to do an how to do it.any tips or advice on how i go about makin the claim??/
    also a lot of people have said they have foned hsbc and they have told them that they is a 6 or 8 week wait.should i fone them????should i wait a little longer or just stick to the plan and put in a claim

    it is only for £200 but could !!! in handy

    Hi there,

    Sent my 1st letter to HSBC last week by registered post to claim back my charges over 6 years. It was signed for on the 19th April. Obviously no reply yet but I have a question, so if someone can help that'd be great.

    The advice on the site seems to be "stick to your own timetable" i.e. 1st letter - wait 14 days - 2nd letter - wait 14 days - take the bank to court.
    HSBC on the otherhand seem to be telling everyone to wait 8 weeks from logging the complaint (as I said, I've no reply yet so this is based on what I've read here).

    I realise 8 weeks is the time the Financial Ombudsman Service says you have to wait before bringing the complaint to them if the bank can't deal with it in a satisfactory way but, now be honest, how many of us are intending to make complaints to the FOS? I think we're heading to court not mediation!

    In that case, do we legaly have to wait 8 weeks or can we just go along with our timetable and ignore HSBC. As far as I'm aware the courts say you just have to give them a 'reasonable' amount of time.

    Isn't 4 weeks a reasonable amount of time?

    So then, my question to all of you. Do we have to wait 8 weeks?

  • Have some fun here. Write to DG demanding a reply, and keep writing. It will rack up their charges to HSBC every time they reply to a letter. Threaten to continue to charge interest for every day from the date of your Moneyclaim claim was filed up until he date of the hearing. Be aggressive (but polite) with DG. Don't let them bully you as it is all postering. Don't wait for them to write, don't let them set the time line - their address is DG Solicitors, 12 Calthorpe Road, Edgebaston, Birmingham B15 1QZ.

    lots of advice on there about claiming through mcol (money claim online) and templates on what to write in claim. Have you sent your LBA (letter before action)? if so go ahead and claim.

    I have sent a list of my bank charges along with a template letter to my bank (HSBC) insisting they pay me £1200 in bank charges back.

    I have had a letter back from them informing me they will look into it and get back to me, it has now been 12 days since i sent the original letter and i requested a FULL responce within 14 days.

    What should i do next? wait for the letter saying "no sorry, your not getting anything"?

    I have a loan with HSBC (£18,000 outstanding), will this affect anything?

    You have two more days til your deadline so see what the post brings today and tomorrow. If nothing then you can proceed with the next step in the process and send the LBA (letter before action).

    With regard to your loan. Your loan account should not be touched as it is a seperate agreement but the bank does reserve the Right Of Set Off. See here for more information:

    Basically, they do have right to set off any refund of charges against this debt but according to the article above certain conditions would have to apply. The money taken would have to be 'due and payable' and they could only take the missed payment not the full amount unless the loan was officially recalled.

    If the loan is offically recalled at this stage and payments have been made on time and are up to date then it would clearly be in retaliation for reclaiming charges and totally unnacceptable. You can complain to the Financial Ombudsman about this and the abuse of the Right Of Set Off. As regards payment of the loan after possible recall you retain the same rights as a debtor as usual with payments calculated on your income and outgoings. They can demand full payment but they cannot expect it.

    This is only an example of what may happen and how to deal with it if/when it does. They may simply refund the charges and not address the loan at all.
