    Hi, I also got rejected by MCOL as the bank filed a defence just in time. The lady I spoke to took some time to find it and said that they are snowed under with defences at the moment and it will take a little time to process. I guess the bank have got their act together and are defending hard. I will keep pressing forward though. I would like to be better prepared for court though. This is a great site. Whenever I get a little nervous I log on and feel better. Good luck to everyone.

  • Hello there, i sent my 1st letter 20 days ago to HSBC Data Protection officer with a 10 pound cheque but the cheque has not been cashed, i assume there could be a back log, i did sent it recordered and i do have the name of the signee for the letter, should i call the Data Protection Officer direct OR call my branch which will probably know nothing about the first letter?

  • They've got 40 days, snipaz, you can't do anything. Unless you have internet banking - in which case you can access all you statements online.

  • Some please advise me!!

    I got a offer from HSBC a few weeks ago for slightly less than my charges, but by that time i had filed with MCOL so i wanted the full money back. I replied to them saying that i would except the amount as part payment but due to the fact that i had to pay the court fee and i am now entitled to the interest i would continue with my claim, although i was happy to settle for £1800 (£100 less than final amount)

    I have now recived a response this letter just saying that they do not agree to the refund of bank charges and although i will not be happy with their response they have clarified their position!! No mention of the £1315 they did offer or anything!!!! They gave me an address to write to should i want to take the matter further....but it was the address i sent the prvious letter to!

    HSBC put in a defence yesterday on MCOL.....thing is, in my offer letter they stated that i had gone back 3 months past the 6 years. Unfortunatly this is correct, and there is £5 worth of charges in this 3 month, which i agreed in my last letter i would deduct from the claim.

    Have i ruined my chances with the court as i was 3 months over the 6 years......even though i have all the correspondance showing i am happy to deduct this and settle for even less!

    I have wrote another letter asking about the £1315 originally offered that i accepted as a part payment and still offered to settle for £1800 before it goes to court.

    Also, will i have to pay out £100 for the Allocation Questionaire, and can i claim this back also?

    PLease help!!!!!! Have i lost completly???

    So I've received a defence from HSBC and I'm plucking up the courage to take my allocation questionnaire (and another £100 court fees) in on tuesday. Am I right in thinking I'll then get a court date and HSBC will hopefully settle before then. Also if they settle do I get back my £100 ontop of the original Filing fee of £120??? This is starting to worry me!!!!

    Yes you can claim back both court fees with your claim and hopefully HSBC will settle before you even get a court date. If they make an offer meantime you can ask that it includes the interest and both your court fees.

    Sorry but this has me confused, why have you written another letter offering to accept less?

    Your case has gone to court now and you have to wait to see if the court will dispense with the AQ as is happening now in which case you won't have to pay the £100 but should you have to pay this you get back all your court fees.
