Hi all
Just a quickie to see if the same has happened to anyone else.
we received a court date of the 20th July and a couple of days later we received a letter from DG Solicitors stating the following:
we have not supplied details of the account holding branch or account number on either the claim form or schedule of charges.
Our client (hsbc) have no customers by your name at the address you give as your postal contact address.
Accordingly hsbc has been unable to identify the account and therefore cannot address the claim.
we have resent these details as it states on the letter that if they don;t have this info they will apply to the court for the claim to be struck out.
Is this stalling tactics by them? any ideas where we should proceed from here or do we just stick it out for the court date?
Thanks in advance0 -
sounds like a bit of stalling/getting you to do more leg work.
Just do what they ask i guess as soon as you can. I haven't been through this but I would probably send everything they say they haven't got, along with proof that your account is registered at your address.A&L - 1st letter requesting money sent 22/03

I would just like to say thankyou to HSBC for the way they dealt with my claim, I have recieved a more than adequate response and the customer service I received was paramount. Unlike Alliance and Leicester who seem to fob you off!!
I know not everyone will agree with me, but I would like to give credit where credit is due!
Thanks

hi kayla,
Did you go down the MCOL route or just sit and wait for a reply from hsbc?0 -
thanks again eyeball
Im not sure now whether to wait or to do MCOL! decisions decisions! Does anyone have any tips on getting them to make an offer sooner? For example could I ring up and say give me 75% of my claim and I will not take you to court!?!0 -
You could ring up and say that, but i doubt they'll listen - i think they're pretty adamant that they'll sort it out when they're good and ready... which is just within the 8 week timescale.
I think you need to decide based on whether you are desperate for the interest and whether you can afford to wait a few more weeks before starting a process that could drag it out for another month or so.A&L - 1st letter requesting money sent 22/03

seeing as Ive "only" around 3 weeks to go before the 8weeks they state is up I'll probably wait for them to make an offer - however in peoples experiences do HSBC stick to there word and make offers in this timescale or do they fob you off with more excuses at the end of this?!
eyeball thanks for your replies you;ve made me a lot clearer on what to do -I cant thank you enough!0 -
Im in the same boat as you tonyf77, in a previous post I did say I was going to file an MCOL on 13th April, but as life always chucks things at you have had to pay for other things so now would have to scrape the money together for MCOL, I've just come off the phone to HSBC, only waited 3 minutes to get through, but the girl couldnt give me any information other than "My claim was being dealt with and I would know the outcome within the 8 week timescale." I sent my original letter on 14th March but they didnt register it until 21st March so they've grabbed themselves another week there!! I dont really know what to do next as am worried that offer may not be satisfactory after the 8 week period??0

It is a worry, guys, you need to work out if its worth worrying about, or if you want t0o throw money at the problem, take it through MCOL, which may help you get more back, but it probably wont happen any quicker.
Like i said before, i'm claiming off two banks and HSBC is the lesser one so i'm giving them time, if the offer is unreasonable then i'll take them through MCOL too, but they seem to be pretty good at sticking to their timescales and coming up with half decent offers - have a scout through the success pages, that may help you decide.A&L - 1st letter requesting money sent 22/03
