I need some help
HSBC should have replied by today but haven't. So do i go down the road of taking them to court or wait the eight weeks (less 2 weeks) from the time they acknowledged reciept.
will they just delay and delay? any experiances out there?0 -
Me too, HSBC have filed a defence today, and I've no idea what happens next! Any light shed on the situation would be great!0

I can see a few people reclaiming charges from HSBC and actually getting success. I sent my first letter to reclaim £4,000 and got a response a good two weeks later saying that they are looking into it. I persevered and sent my second letter, and have heard nothing!!
This was about 4 wks ago now. Tried to phone them yesterday and they said that they could not discuss the accounts with me, as it is a joint account and they do not have my Date of Birth on file???????????
Have you EVER heard anything so ridiculous?? How come they have given me a card and allow me to withdraw money, yet they don't have all my personal details?? Madness.
Anyways, I know the next step is registering a claim with MCOL, I'm just waiting for my wages as I sadly haven't got £30 to my name at the mo!!! Why are HSBC ignoring me???DFW #414, MoneySaver, Income Booster

Yes, ridiculous, but they're obviously using delay tactics like many banks are doing. You're well within your rights to start court proceedings if you've not had a reply/received an unsatisfactory reply. Go for it ... you'll get your money back.

I started MCOL for two accounts against HSBC on April 5th, they acknowledged on 12th April but since then i have heard nothing :mad: , i think they now have until May 5th before i can file for judgement! :j Fingers crossed, i'm expecting the defence letter from their solicitor any day now though. I have pre-empted them however as i have sent off summary of charges to both the courts and HSC's Solicitors.

I got exactly the same defense from HSBC.
I too was hoping it wouldn't reach this stage, but I've paid the MCOL fee and I'll be damned if I'm losing that too, so it goes all the way from here until they give me back my damned money that they stole from me :mad:
The court I'm going through seems to want me to fill in a questionnaire though, but I doubt that'll be too hard etc.

Looks standard defence is probably a delay tactic giving them time to wade through settlements. Some stats for your viewing pleasure from the first 98 pages of the success thread:
HSBC - 115 cases of which:
72 cases settled for less than the amount claimed but for not much less than claimed, presumably without interest
32 cases were settled in full without the need for court and some after the first letter only
7 were settled for more than the claimed amount, no mention of court in these cases and I assume interest was given before court
Of 4 court cases noted:
2 were settled in full by, the bank did not defend and default judgement was awarded after 14 days
1 settled in full after court claim filed
1 settled for less after court claim filed and it was accepted by the claimant

I managed to get back 90% of the charges that HSBC had charged my wife after only 2 letters and said i would help our friend claim hers back.
but she has received a reply to her second letter stating the bank doesn't agree that the charges are unfair and go read the t and c's etc etc.......
i am assuming this is a put off tatic-after all if they can fob a percentage of the people who claim into not taking it further they are saving themselves a wad of money
