Help, am not sure what to do. I have sent the 1st 2 letters, 12th & 26th March respectivly. There is confirmation that they got the 2nd letter as it was signed for but after another 2 e-mails they still have not sent me any corispondance. As I am doing this for my husband and it isnt a joint account I cant phone for him. And he cant call as he works all the time they work and only has a pay as you go phone plus he hasnt got a clue about this stuff and cant be forcefull. I am contemplating sending them a fax of all the details again as I cant afford the courts for a while. Can anyone help?The will to save every money saving penny we can0

sending you acknowledgment of recieving letters is a bit hit and miss.... i only got confirmation of my first letter dated 14th march, the letter they sent back was dated 27th march, i didnt get any correspondance acknowledging my 2nd letter, when i phoned they told me my claim was being dealt with which takes 8 weeks from them registering your first letter. The first letter i sent was registered on 21st march a week after i sent it, so they have until the 16th may to make me an offer....Help, am not sure what to do. I have tried to get the answer to my question by scanning the thread but 109 pages was too much for me.
Basically, do I understand correctly that the bank has 8 weeks to finalise the claim?
Since sending my claim letter, they have charged me another £50 on a different account. Should I send a separate claim for that or will that jeopardise the initial one?0 -
Does anyone have a fax number for the quality service team?
DollyPeach, I have heard on other thread bits, forget where, of people calling the bank the minute they see the charges on the account and arguing a refund there and then. Its worth a shot, I would sujest the 08457404404 number as I think that gets answered more or you could try going into your local branch or get the bull by the horns and call the quality service teamThe will to save every money saving penny we can0 -
Hi no joy yet, am a bit confused about what is happening at the moment so would be good if someone can help by explaining (without abreves if poss).
Had my allocation questionaire thru filled it out, not that much needed filling and sent it back, what happens now??? Charges keep building up and I am tempted to send a further claim to 'sir colin of time waisting' requesting that he refund my charges since jan 07 ontop of original claim before its gets to court (is this a good idea, nearly £1000 since jan)

According to the OFT they have 8 weeks to look into it and give you an answer. This answer may be we are right get lost in which case you go further, but they have to do it in 8 weeks. Buut looking on threads, its currently only taking them 5 so you may be waiting less time then you though.The will to save every money saving penny we can0 -

Unfortunatly you wait. You will get a letter from the solisitors asking for another breakdown most likly, then wait for corrispondance from court with a date and place. Fingers crossed you will get a settlement letter.
Least I think so. But dont panic, you can always call the court and ask how the claim is progressing and ask what comes next, even with out a claim number.

hi hsbc have filed a defence, is this normal? it reads; "1. the claimant?s account is governed by the defendant?s personal and/or business banking terms and conditions.
2. Pursuant to the defendant?s terms and conditions the defendant is entitled to make a charge for its services as set out in the defendant?s price list, including an overdraft review fee for considering whether to provide and providing and overdraft.
3. The defendant denies that the charges applied to the claimant?s account amount to penalties at common law and/or unfair contract terms for the purposes of the unfair terms in consumer contracts regulations 1999 (UTCCRs).
4. The charges applied to the claimant?s account are reasonable and are properly and fully disclosed in the defendant?s terms and conditions and published price list. The charges represent the contractually agreed price for the services provided and the UTCCRs are not applicable to them; alternatively, they are not unfair contrary to the UTCCRs. Further, the charges are not default charges and, accordingly, cannot amount to a penalty.
5. Save as set out above, each and every allegation made by the claimant is denied. For the reasons set out above, it is denied that the claimant is entitled to the relief claimed or any relief.
I have claimed statutory interest and the total amount claimed is about £2000. The court does not want a Questionnaire.I have been slow and do not have a parachute account. Do I carry on? Is this normal? I cannot afford to lose any money. All replies gratefully received
