  • hi, brand new poster but started the reclaim process a few weeks back. claiming on 2 accounts, both with hsbc. recieved the standard repsonse of "we are looking into it" today for both of these accounts, which has just made it inside the initial 14 day deadline which i set out in my original letter. having read through previous posts it would seem that hsbc are experiencing a backlog (poor them eh) so do you think i should proceed with my original timescale & send off the threat of court action tomorrow or give them a couple of weeks or so grace, in case the backlog is genuine & i only inflame the situation without giving them time to make me an initial offer?
    any advice from fully paid back veterans of this process greatly appreciated.

    A little advise please.

    I am just going thru my First Direct (HSBC) statements. It states overdraft fee + excess overdraft fee. I know I can claim for the excess fee but can I claim for the overdraft fee only I do think £30 is a lot each month.

    I've looked on your post with a list of charges but it doesn't actually say.

    Right i'm getting scared, HSBC have put in a defense against my claim and it is now proceeding to the County Court. Do you think it will get this far, and if it does what can i expect. Please help as i am starting to panic.

    A couple of stats taken from the first 98 pages of the Success Thread which may reassure you a bit:
    HSBC - 115 cases of which:

    72 cases settled for less than the amount claimed but for not much less than claimed, presumably without interest
    32 cases were settled in full without the need for court and some after the first letter only
    7 were settled for more than the claimed amount, no mention of court in these cases and I assume interest was given before court

    Of 4 court cases noted:

    2 were settled in full by, the bank did not defend and default judgement was awarded after 14 days
    1 settled in full after court claim filed
    1 settled for less after court claim filed and it was accepted by the claimant

    If you end up actually in court it is unlikely they will turn up. This post details what happened in court for one woman who claimed against Barclays, different bank I know but to illustrate what can happen. Top thanks to OP showmethemoney! for her post.

    Hi Emma im in exactly the same boat as you, i did start to panic too but i dont think anyone has actually lost a case but i am going to read up about where i stand etc from the consumer action group web site though have you been given a date yet?

    I havent been given a date yet, but I looked on the moneyclaim.gov.uk and it said a defence had been put in. Although it says the defence was put in 2 days before they acknowledged the claim:confused: Maybe I should ring moneyclaim and ask them about that ????

    From what i've read, i'm feeling slightly more confident, although if i get to court i may have to take OH as moral support (I'm a very shy, unconfident person).

    Save yourself some money on your phone bill my claim did exactly the same and when I rang up they said that they would allow a defence, I'd already clicked judgement by default but later that day it came up that defence had been entered again 2 days before they were served. I got my letter of transfer to Dewsbury yesterday and they actually entered defence on 4th April not 7th March like MCOL said. MCOL won't tell you very much at all, don't think they have clue either!!

    I have sent details of all my charges to HSBC via recorded delivery on 28th March, received a letter back saying they are looking into it (about a week later) and not heard anything since. Should i just wait or contact them again?

    I cant beleive hsbc they have lost the letters we took into our local branch to claim our charges back , grrrr am so angry with em for this we could have taken the letters in again if they had let us know when we first telephoned them to make sure that the right department had recieved our letters .
  • Hi I sent my letter to my HSBC branch, addressed to Colin Langdale, on the 3rd April, recorded delivery, and today it was returned to sender, with 'refused' marked on the sticker.

    What does this mean? DO I need to send the letter elsewhere? Or can I plough on and send them my letter before action? Surely they can't just 'refuse' post from their customers?

    Thanks in advance for your help, I read these boards a lot but have not posted before...

    I've been thinking about reclaiming my bank charges for a few months now and to be honest just haven't got around to it.

    However, I just logged in to my HSBC account and clicked the "Charges to be applied" button. £125!!

    That's for being over my overdraft last month and several transactions going out within a couple of days.

    Absolutely ridiculous, so I have just downloaded the letter and it will be on its way tomorrow.
