  • it's been 40 days since my initial letter but no reply - what number do i call to chase this up? i only have the customer service number for speaking to foreign people.

    also, if they fob me off, how can i proceed without knowing how much to claim for?

    I have just phoned the complaints team to see how my claim was progressing as HSBC have until friday otherwise I'm filing an MCOL, all the fella could tell me was that HSBC had received my first letter dated 14.03.07 but hadn't received the breakdown until 02.04.07, I told him I didnt understand why as the letter and breakdown were sent together TWICE, once on 14th and then again on 28th... He said that he couldnt tell me if an offer was going to be made just that my claim was being dealt with, so I'm going ahead and filing the MCOL on Friday 13th (unlucky for some). I wont be taking any offers or backing down as I will be wanting the court costs refunded too!!

    I will keep you posted at any progress made...

    Hi everyone, just need some quick advice if possible?

    I sent my 1st letter requesting refund 13 days ago, I received a response about a week ago saying they are looking into my case.. blah blah blah.

    Do I continue with more threatening letter tomorrow?

    Also, as it would seem likely that I have to file a court claim, what are the chances of them putting in a defence? And if they do, what happens then? Could I lose and end up spending even more money??? Please help!!!
  • I sent the first letter to my bank (HSBC), received a letter back saying they were looking into it and would contact me once the investigation was complete. Its been a feew weeks now, should i send the second letter or await a response from my bank? Could they just be stalling me on making a claim?

    Hello,

    I had two accounts with HSBC. Both incurred charges of £700 quid or so - with interest this came to about £900 for each account. I followed the timetable suggested on this site and wrote asking for the full £1800 back. I was eventually offered (in two separate letters) £600 on the one account and nothing on the other account. I didn't deem this sufficient so I made my claim through Moneyclaim.

    They acknowledged this and I waited for them to enter a defence, knowing that after 28 days I could claim a judgement by default. Today, 27 days later, they have. The message on Moneyclaim says:

    "Defence

    You are unable to take any further action online on this claim.

    The Defendant disputes the whole amount you have claimed. Your claim cannot proceed online and will be transferred to the appropriate court for continuation. You will receive confirmation to where the claim has been transferred to shortly."

    I'm worried now. How rare is this? What do this do to my chances of getting my money back? Will it actually go to court? Any advice whatsoever would be gartefully received.

  • Stalling you bigtime... just give them 14 days between each letter and no more. I would suggest you send the next letter tomorrow.

    I clicked on judgement by default this morning and this afternoon it says that they are defending the claim which is dated 7th March ( 2 days before they were served!!!) So now what? Surely this can't be right I spoke to a Lady at MCOL who said that we could do judgement by default!

    Mine said the same as the post above..., There is nothig you can do..... defendant disputes all of the claim etc.

    But this morning it didn't say defence, it said acknowledged
