HI All, and congrats to all those who have won and keep going!! to all those still fighting!!
I sent my letter requesting my charges back on 28th March, giving them 14 days to pay up. I've just received the standard letter from Colin Langsdale dated yesterday saying he's looking into it. I've got my LBA, should I still send this even though I've received a reply?

In the process of claiming around £2500 from HSBC. Yesterday I requested judgement by default on my MCOL after the 28 day period but HSBC entered a defence this morning before it was filed. I get the impression from the boards that this is happening a lot more lately. Any words of advice / support appreciated. Has anyone actually been to court yet?
Cheers and thanks to all, particularly Martin for the info and advice up to this point.
Hi
This is frustrating normal for HSBC. Standard procedure is for an Allocation Questionnaire to be sent before you get a court date, however AQs are being dispensed with by many local courts as judges are getting fed up with the time wasting tactics of the banks. This will cut out about 2 weeks from the court date and just before that you should receive your offer. Keep going.
(I'm in the same boat, on day 27 at MCOL, will be filing for judgement at midnight to be on the safe side by HSBC will notoriously file in the morning and it will override my filing... Keep posting and we'll compare notes!)Lou0 -
Thanks Lou,
I'll battle on then and i'll keep updating my progress.
Best of luck with your claim. I made the mistake of requesting the default judgement in the afternoon and gave them a whole extra day.

Can anyone help ? I am claiming charges back from HSBC and I have followed the Martin Lewis Procedure the last letter I sent was asking for my money back and they had 14 days to respond I didn't hear after 14 days then got a letter saying they are looking into the situation. I then contacted them and they said they have 7 weeks to reply is this true or shall I just go ahead with the court proceedings ? I don't want to go ahead incase they are correct ? But I feel like they are phobing me off !!!0

They are stalling. You heve given them plenty of time if you have followed Martins steps. Go for it Good LuckStick to YOUR timescale. Dont take ANY bull. DONT be intimidated. The law is on OUR side.
Feel free to thank me if I was a help

I have also received this letter from HSBC.
I called HSBC to find out what their time scale for response was and was told it's 8 weeks from the date they received my original letter.
I was reluctant to send the 2nd letter as HSBC's letter arrived on the 14th day after I sent mine.
The letter from this site says that a response is required by the 14th day, not money.
Is the advice to send the 2nd letter correct baring in mind the wording of the 1st letter?
Help!!

I have had the same thing happen to me and am not sure whether to start court proceedings yet.
HSBC have had 3 letters from me - following the MSE procedure. The last said I would start court proceedings if I didn't receive a response within 14 days.
I have received a response but it is not satisfactory - "we will contact you after we investigate".
Does anyone know what my next move should be?
Thanks in advance0 -

Hsbc are playing hardball with everyone. I 1st put my claim in for nearly £3000 in dec06 we are now in april, and i have just sent off £100 to the proper court for a date, after £120 to mcol. Still, costs should be paid by them and £3220 will come in useful!
Stick at it, it's your money stick to deadlines and it is just a matter of time.0
