You're in the court system now so you should expect to at least 14 days (probably 28) for them to acknowledge and go from there. You might be weakening your position by contacting them at this stage by looking a bit desperate. If you hang on a bit longer you'll get your interest and costs back too.
Remember that suing a bank is a pretty big deal and they would expect that you've thought through the risks etc, I would sit firm and just hang on another week. Good luck.Lou0 -
Just filed my online claim for just over £4500 (including interest and MCOL fee), very scary pressing that "submit" button!
Am in the process of dealing with business acount too, but am a bit lost as it's not clear what was charged for running the account and what was charged for going over the overdraft limit. Any pointers?
Does anyone know how long it takes to hear back after filing MCOL?

They will probably acknowledge your claim very quickly giving them 28 days from date of service to respond. They will either file a defence which will lead to Allocation Questionnaire coming out to you and another couple of weeks' wait or they won't file a defence and you win by default.
For your business account (I've just won £10,500 on my business account claim) you need to claim for the same penalty charges using the same process as for personal claims. However, if you are a Limited Company the letter templates are different as are the Particulars of Claim wording. The Consumer Action Group has plenty of advice for business claims so you might want to take a look there before proceeding...Lou0 -
Just wondering what i should do next i sent my statment request letter
22-02-07 got a reply saying " have recieved your letter and will process it and here is your £10 cheque back as we dont charge " then heard nothing so on 02-04-07 i hand delivered the 2nd letter saying you have 7 days before i contact DPA and inform the 40 day rule has been broken still i have heard nothing help!!!!!!!! what should i do next?????

Hello everyone,
I have sent a letter to HSBC to reclaim bank charges for £1761.25. The letter they responded to me says:
"I am looking into the matters you have raised and will contact you with a full response as soon as i have completed my investigations"
Has anyone had this letter if so, what did you do as they have not said when they will get back to me.... do I need to send them another letter giving them a time to repond by? or do i just wait?

hi, if you gave them 14 days in the first instance fire off the 2nd letter giving them 7 days before you take court action. If not you will find that you will be waiting a long timejune debt totals:

stick to your timescale...give them 14 days to pay. If no response give them 7 days notice of your intention to take them to court. Then take them to court.Stick to YOUR timescale. Dont take ANY bull. DONT be intimidated. The law is on OUR side.

I wonder if anyone can help me. I made a claim against HSBC for £1484.50 plus interest. I have filled the claim with MCOL and they have 10 days left to put in a defence.
I recieved an offer letter from them last week for £1313.55 which i am not happy to except seeing as i have now paid out £120, and i am entitled to the interest aswell as the court cost making my claim £1922 in total.
However in their letter they noted that i went past the 6 years, all by 2 months, which was a total of £5 of charges, also that i agreed to a charge of £20 over the phone (which i dont rememember but hey ho!)
I tried calling HSBC today but they said that they can not discuss over the phone and any quiries will have to be put into letter and the investigation will be reopened.
I have now wrote this letter:
I cannot accept your offer of £1313.55 as full and final settlement of my claim. I will accept this as part payment and without prejudice, but will continue my claim for the rest. I have made a reasonable effort to settle this claim before issuing a court claim, but you ignored my efforts to settle this.
Following on from your letter dated 2/4/2007, I accept your points to certain refunds you can not make, therefore I have reduced my claim by the amount that you dispute, which is £25. This makes my total to claim now £1459.50. I have attached a new spreadsheet detailing this. Seeing as I have now had to issue a court claim because of your failure to deal with my claim in a timely way, I am entitled to claim for the full amount of £1459.50 in charges + £319.44 in statutory interest + £120 court fee, totaling £1898.94 plus any other fees that I will incur should this go further.
However, I am willing to settle for £1800 as full and final settlement to drop the case, therefore leaving £486.45 left to pay.
Could some one please tell me if i have ruined my chances with the MCOL claim seeing as i was a few months over the 6 years so the amounts are now different to what i am requesting in this letter??
Any suggestions will be greatly appreciated before i send this letter off!!!

Please note is is recommended you give them another 14 days not 7 in the Letter before Action as per the template.0

I'm filling for £1150 worth of bank charges after 7 weeks and a number of phones call HSBC have finally made me an offer of £899. Question would it be wise to accept this offer or should I push for the full 1150???
just wondering if they made you the offer over the phone? i too have waited 7 weeks with no response from HSBC and phoned them today to be told i will be recieving offer in post but he wasnt able to tell me for how much over the phone. dont know if they are just buying themselves more time as i`m sure they were able to make you an offer over the phone?

You are highly likely to get your offer within the 8 weeks they specify. Only occasionally will they tell you the detail of the the offer that's going out in the post to you - guess it's pot luck as to who you get on the end of the phone and how amenable they are. Worth noting that their letters do not arrive overnight... often 4/5 days after they say they've gone - but you will get it.Lou0
