    :D first of all thanks to all for help!

    i got an agreement letter saying i could have the full amount from hsbc (£551) which am very happy about. its says they will crdit me account with in 7 working days. the only problem is its now been over 7 working days and when i phone they say they are very busy and doing there best. i understand there must be a lot to go through but it cant take over 7 days to credit money to an account. should i think about calling them and speaking to someone in charge, or leave it for a little longer? also has anyone else waited so long for the money back once they agreed the refund???

    I am not an expert but I think these are service charges not penalty charges for going overdrawn so no you can't.

    I honestly don't think you can in this case I'm afraid.

    Maybe I'm wrong, what do others think?
  • No, unfortunately - I investigated this myself for a similar foreign currency transaction charge and it is not claimable.

  • I sent a letter (not recorded delivery) requesting the previous 6 years Statements from an old closed HSBC account. I used the template on Martins site and included a cheque for £10.

    The cheque as of yet has not been cashed, nor have I received any letters or statements. I'm now closing onto day 38 of the allocated 40.

    I have already tried to get access to my old statements via the Internet Banking, but for some reason my details no longer work.

    What would be my next step?

    I spoke to MCOL this morning, and they told me the allocation questionnaires have been scrapped, as the banks are wasting court time, by not turning up.

    However I was informed that I have to pay an additional charge at the county court.

    Apparently the judge decides what the charge will be, but she said it is normally in the region of £275!!!!!!!!!!!

    I am overdrawn at the moment, and still being charged by HSBC.

    Can anyone share what they were charged at the county court for the hearing? Clearly you have to pay the charge before the hearing.

    HI just to lert you know it took me 4 weeks to get them pay back my £160.first they let me know it was ok they have charged me, so i have sent them secound letter. get reply of paying me back half the money (£80), so i have sent them the 3 letter. recived the letter today, they will pay back £160 just i have to sign some letter from them confirming i will not take any legal action if they will pay back the money. it was quite quick to get the money back for me.
    good lack to everybody, push them to the limit and they will pay.

    Hi, hope someone can help. Have been reading the boards for a while now but so far have been able to find the answers to all my questions.

    Claiming nearly £7k from HSBC and have got to MCOL stage (2 claims to keep in small claims track). HSBC acknowledged on 13/3 and stated they intended to defend the whole amounts.

    What I need to know is: I haven't heard anything from them at all, should I have heard something from their solicitors if they intend to defend? or should I have received an allocation questionnaire or is that only once they submit a defence?

    Their time is up on Tuesday so I'm kind of hoping we might slip through the net and get judgment by default with all the bank holidays.

    Any advice would be appreciated. Cheers!

    I think, if you haven't heard anything tomorrow, you will probably win by default on Tuesday because of the bank holiday.

    If you look up a couple of posts Marylina has been told the AQ is being scrapped.
    Not sure what implication this has as Im not at this stage yet.. will be on 23rd April :-)
