When done on MCOL this defaults to Northampton court, however if your bank defends the claim it will automatically switch to your local court.

So this is ok, well done

Thought I would tell you after my patient wait, they put £150 back in my bank yesterday without sending me any letter to tell me, just £30 short of the £180 I claimed, so I am happy! Maybe they are that snowed under they are giving in and paying back the charges without correspondence??
LUCK COMES TO THOSE WHO WAIT PATIENTLY :)

I sent my first letter on the 26th January. They acknowledged on the 3rd February.

I sent the 2nd letter on the 8th February. I called the service quality team on the 21st february, and they told me they were looking into it. I called again, a couple of days later. They claimed they had sent an offer, but the letter had been printed but not posted

I waited a number of days, and nothing in the post. Another delaying tactic.

Filed with MCOL on the 5th March. HSBC acknowledged on the 6th.

I have just checked on MCOL, and HSBC have put in a defence today.

Could somebody tell me what the next step is? My claim is just over £1500.

I assume I have to pay £100 to go to court.

At what point do I need to pay this?

Will the allocation questionnaire be the next step?

    Thanks

The £100 fees should of been paid when you filed with MCOL.... as when you did this you were filing a court claim
Thanks to everyone that posts :T:money:

Hi,Im after some of your thoughts please.I have sent my first two letters to Leeds and a couple of e-mails via the on line banking service (which were actually pretty helpful-always had a reply within a few hours).Yesterday I got an e message saying that an offer had been posted the day before.I would have expected it to be delivered today in that case, but nothing.
My concern is that the only letter I have had (from Colin!) was dated nearly two weeks before it was delivered. Can I expect this with my offer too?Should I push on or just wait?Any advice appreciated, thanks!

i recieved a letter (from Colin) yesterday which was dated 27.03.07, the letters are computer generated but probably sit in the out tray for a few days!! If you don't recieve a letter after bank holiday weekend then I would stick to your own deadlines and go to next stage, everything they do seems to have a delay tactic attached to it...

Just wondering if anybody else has come across the following. I was told that next week I would get a letter with an offer (don't hold my breathe) but I was told that HSBC's policy on refund is that you don't refund the charges plus interest. The only way to get the interest is by going to court. To put it one way are they talf c*ap or not, or should I push for the full amount (£1250 which includes the interest?)

Hovis, you are only really entitled to the interest when you get to the court stage. If you receive an offer of the full amount of your charges you should take it. You can't push for interest before issuing proceedings, think of it as a negotiating device until then...

    Hi,

Im in exactly the same position, their (HSBC) time was up on Monday for me but im holding out til tomorrow before making the claim. In the back of my mind though i want the full whack, which will be about £1600 inc int

Im not sure whether to wait although i do want the whole lot back so i dont know why im delaying, haha

    :D

Shelley - see above. If you can file with MCOL today, claim your interest up until today's date.
