Just wondering if anybody else has come across the following. I was told that next week I would get a letter with an offer (don't hold my breathe) but I was told that HSBC's policy on refund is that you don't refund the charges plus interest. The only way to get the interest is by going to court. To put it one way are they talf c*ap or not, or should I push for the full amount (£1250 which includes the interest?)0

I have just used the interest calculator to confirm my total claim and it isn't far off what I have claimed through the court. As long as it's not below the amount I claimed will there be a problem? Hope this makes sense.0

Hi Can someone give me a bit of advice please? I wrote to Abbey using the 1st letter and they received the letter on the 2/3/07 they then sent only the last 14mths worth of statements through giving some excuse about the rest being on microfiche.
The 40 days is nearly up and we've heard nothing. What do I write to them after the 40 days are up if I still have receieved nothing?

Also received many (3) delaying letters, did not give them the time, started the claims when I said I would. They have entered a defence so now progressing.0

I'm sorry to say that you have done this incorrectly, you don't just add 8% at the end of it, use Martin's calculator as it works out 8% APR from the date you you was originally charge to the date that you're claiming (completing the calculator) on each charge. So the early charges have more interest than the later ones.

Previously read on this site something re this but can't remember where - sorry
Anyway apparently you can only insist interest if you go to court.
Not advisable to go to court if bank has already offered to repay full charges as judge would take the view that they were righting the wrong.
Hopefully someone will see your question and post more info.
If they don't offer full amount of charges though I would continue to court stage but I suppose that will depend on how much they are willing to offer.

Im in exactly the same position, their (HSBC) time was up on Monday for me but im holding out til tomorrow before making the claim. In the back of my mind though i want the full whack, which will be about £1600 inc int
Im not sure whether to wait although i do want the whole lot back so i dont know why im delaying, haha0 -

I have filed with MCOL and they have acknowleged which means they have until 23rd April to file a defence.
Today I received a letter from HSBC:
Thank You for your letter dated 19th March requesting a refund of all your bank charges passed during th 5 years. 5 years? ahem.... 6 actually
In order that we can consider your request, please provide a full itemsied breakdown of these charges to include date, description of the charge and the amount applied. Please also include any proposed new charges that you have received a pre-notificatiopn advice for. (You know I have none Mr Bank Manager - you have access to myaccount info)
Your breakdown should be in the form of a list quoting date, amount and description of the charge from your statements. (You don't say, oh yes you do, in the previous paragraph. And this will be the list I already sent you twice then)
If you use Personal Internet Banking, you can obtain this information from your previouse staements on the internet. (I know, but you still sent me 6 years worth of statements, in 72 envelopes)
blah blah blah...
Honestly, why are they bothering with the run around? They know that I know that they know they will settle 2 days before the court hearing.
Such a waste of time, energy and resources.

I know exactly what you mean bout that by the way...Simply Be said they will refund charges from the OFT date knowing full well the account has been closed for 4 years!...They were first on the MCOL list!:D0 -

I have completed my AQ and will be posting this tomorrow, my question is - my original claim does not include the 8%apr int that can be worked out on the calculator, can I still claim for this when I get to court if I add it all up before hand?0
