    Hi i was wondering if you can help me, i knew that i was going to go overdrawn so i called my bank and asked for a overdraft for doing this they charged me £25.00 i then needed to up my overdraft so again i was charged £25 then i requested that my temp limit be extended for another month and guess what i was charged again! I didnt realise this till i got my statement through and it said i was having £125.00 taken from my account in arrangement fees for one month, i might aswell let myself go over drawn i would of been charged less!
    I wrote a letter to complain and the reply i got back was i dont get charged for having a direct debit facility on my account and dont get charged for my wages being put into my account, but i do pay a charge on my account each month!
    Can I claim these arrangement fees back??:confused:

    I'm worried now. How rare is this? What do this do to my chances of getting my money back? Will it actually go to court? Any advice whatsoever would be gartefully received.

    Yes, they have filed defence on day 27 today for me too. B*gg$rs. If you flick back a couple of pages on this thread, you'll read my earlier post about Allocation Questionnaires. To recap - the next step is the pack you get from the court containing the AQ which you send to local court (with £100 if claim is over £1500) to get date. However, the judges in many local courts aren't using them now as they know this is a time wasting tactic by the bank. You should get a date a couple of weeks quicker (probably 2-3 weeks from now depending on how busy etc) and you'll get you dosh a few days before the court date.

    Despite the !!!! factor of the defence being filed, be positive that you're on the home straight. Keep posting, we'll compare notes seeing as our dates are the same...

    Just make sure that you don't get asked to close your account if you claim again - that's standard on many offer letters...

    Exactly the same thing happened. Claim said acknowledge, completed judgement by default and then later today suddenly changed to defence!

    I actually phoned MCOL after the judgement by default went through to check that a defence could no longer be submitted and they confirmed that it would take 48 hours for the paperwork to go out but was effectively done and dusted.

    Then 2 hours later complete change of scenario!!

    I am going MAD!!! I have sent MCOL an e-mail asking them to confirm how defence can be submitted after the published 28 days has expired - I will let you know if I hear anything.

    I appreciate MCOL are probably drowning under all this bank stuff, but surely if they stuck to procedure it would make everyones lives easier!!

    I'm in the same boat as you now. Hsbc have until Fri to register their defence and i was planning to hit the button at midnight on Fri. I haven't had the usual letter from their solicitors asking for a breakdown. They made me an offer about a week after i'd registered with MCOL, if they'd done it earlier i would have accepted but with the MCOL costs as well it fell about £450 short so i rang them and declined. Fingers crossed for you let us know how you get on.

    Sorry louloujs, just read your last. It's annoying that the banks are allowed to *&%* the system like this surely its not legal.

    Sadly it's true. Judgements on MCOL can be overriden up to a few days afterwards. On an earlier claim I had judgement for 3 days until they filed their defence. According to MCOL it's all about fairness and giving opportunities for claims to be settled in a straightforward fashion.

    Errr, i disagree somewhat.

    But just remember peeps: This is all about mind games and pressure from the big boys. How many people will find out that a defence has been filed and drop everything in a panic? Probably many and that's what they're banking on (excuse pun).

    So, we're not going to fall for that one are we? Just wait for your court date happy in the knowledge they don't have a leg to stand on...

    AAArrrgghh - I find the whole thing so frustrating - I am not a patient person at the best of times but this is really pushing my limit!

    I just don't understand why there is a published procedure which is ignored! HSBC have already had 8 weeks to get in contact BUT NO, they have to push for just a little bit more!

    I will not back out - even though my head might explode in the process!!!!

    I wrote to HSBC claimimg £2200, inc interest. They wrote back (after my threat to start court action) offering £1400. I rang to say I wanted to negotiate the amount, and was told I'd have to write a letter.

    I'd read about another user here, who succesfully got a response from HSBC via a few emails. I tried this, and was just told my email was being dealt with by the appropriate dept.

    This was a few weeks ago, and I've not done anything - largely due to being really busy at work.

    I will start a claim with MCOL in a day or two, when I put the amount I'm claiming, do I recalculate the interest, as my claim was started in early February, and I'm sure there'd be a few more quid to add ??

    Also, having not kept the ball rolling and let it simmer for a few weeks, have I endangered my chances ??
