  • Do you have to include the nature of the charge? Is the date and amount not sufficient enough information?

    From what ive read on here and from Friends experiences NO it isnt !!

    If you `wing it` and just put date and amount of charge they will more than likely write to you asking for a full list of charges including type of charge ...

    It will then hold up your claim even more!! xx

    I have recieved my aknowledgement letter from MCOL but it states that it has been sent from Nothampton County Court, and HSBC's solicitors are DG in Birmingham. I live in Essex!!!!! Is this right, or have they issued my claim to the wrong court?

  • Just got off the phone to HSBC ......................it took them 10 mins to answer and a very polite young man answered......:) different to my last call

    They said they are working to the 8 weeks timescale set by FO and that they are managing to clear their workload within that timescale.

    I questioned when the eight weeks starts from as I sent my 1st letter on the 01/03/7 but they didn’t receive it in their office until 20/03/07 (when I faxed it all across) they said it would start from the date of my 1st letter and that a letter went out to me yesterday and my case would flash up the teams system for review on the 12/04/07

    That’s is 6 weeks from the date of my 1st letter...!!!!!

    Can any one tell me how long it takes from day one of filling in the form with MCOL?

    Do not allow them, 8 weeks, just continue with your own timetable as per the Step by step guide. Also see the FAQ in the Reclaim Help thread in my signature.

    All MCOL start at Northampton and get transferred to the claimants local court.

    Hi all

    My story so far. Mid Jan i wrote to HSBC for my stmts cos for some reason i could only go back two years on the net. Received all of them within 3 wks and immediately totted up charges.
    1st letter sent 16th Feb giving 14 days bank responded within 13, looking into it.
    2nd letter (lba) sent 1st March giving 7 days not response.
    Rand 0845 no on 9th March on hold for more than an hour gave up.
    11th March registered MCOL for £1091 charges, £235.38 int and £120 MCOL.
    17th March deemed served
    21st March bank responded saying they will defend claim
    24th March received 2 letters, 1 from bank offering £927 the other from MCOL informing of bank defending claim.

    If this offer had arrived earlier i would have accepted it but obviously now i've had to pay £120 to MCOL the offer is effectively only worth £800. For the sake of a few weeks i've decided to hang on and see what happens.

    Rang the 0845 no today to let them no what i'd decided, only on hold for 10 mins. A girl told me that they had no record of my court claim and that now i had taken it this far they could not enter into correspondence with me, although if i wanted to either accept their offer or write to them stating what i will accept then they would review it. I pointed out that she'd said they could not enter into correspondence with me so there would be no point and that there would be another £100 when it got to the AQ stage, she told me that no one on that number would be able to increase the offer but i could write.

    I'm going to sit tight for now but i will write to them and tell them that i'll accept a higher offer but it will need to be a good one. We're going on holijday soon so it's very tempting to accept but then as it's money i thought i'd lost i'm going to hang on.

    I've noticed the bank seems to be very inconsistent everyone seems to be getting a different response although most seem to be getting what they want in the end. It's frustrating but i'm encouraged by the amount of positive results on this sight.
