Just got off the phone to HSBC ......................it took them 10 mins to answer and a very polite young man answered......:) different to my last call

They said they are working to the 8 weeks timescale set by FO and that they are managing to clear their workload within that timescale.

I questioned when the eight weeks starts from as I sent my 1st letter on the 01/03/7 but they didn’t receive it in their office until 20/03/07 (when I faxed it all across) they said it would start from the date of my 1st letter and that a letter went out to me yesterday and my case would flash up the teams system for review on the 12/04/07

That’s is 6 weeks from the date of my 1st letter...!!!!!

Can any one tell me how long it takes from day one of filling in the form with MCOL?

i sent my 1st letter on 16th Feb and im now waiting for my offer to arrive

they say 8 weeks but if your not prepared to go to court the average time is approx 5 weeks (from looking through the thread and speaking to the people on the charges team)

If you dont want to go to court then keep ringing and asking, the more you nag the more your case gets looked at!

Ive rung every day for a week, this time last week i was told i would be lucky to get anything before 18/04 but NOW after nagging .. im told a letter was sent with an offer and if i dont receive it by tomorrow then i have to ring up and they will re-send it or fax it :)

Im glad i didnt have to go to court etc. i couldnt afford it and i didnt want the hassle really, im going to take my money when i get it and pull myself out of this black hole im in :T

    Good luck!! x

    Thanks Natalieee :)

I cant afford to take them to court at the mo and was considering borrowing money in the hope that the court process would be quicker but reading on here it doesnt sound like it will be any quicker...............

Do not allow them, 8 weeks, just continue with your own timetable as per the Step by step guide. Also see the FAQ in the Reclaim Help thread in my signature.

wish i could but taking doing that would make me overdrawn again.................lol not a good idea

    snookered really :(

    Its Okies :)

I dont think its quicker to take them to court but maybe if i had a bigger claim i would be more inclined to do so to make sure i got a decent settlement!

My advice is just to keep ringing, most of the people ive spoken to are lovely and they really try and help you!!

    xx

Yes, send another breakdown - you're doing everything to cover yourself and giving them every opportunity to check what you're claiming.

I've just read a couple of success stories on this site - HSBC have paid out both just after the AQ has gone in and whilst a court date is being waited for. It's a pain that you've got to fork out the £100 in the meantime, but looks like you're nearly there in terms of offer timescales. My AQ should be here next week...

Thanks Lou, fortunatly my claim is under £1500 so i dont have to pay the £100 it says in my letter that accompanied the AQ "........Return it, where the claim is over £1500, the court fee of £100 to XXXXXXX county court" Am i reading that correct or is the £100 charge for all claims??

    Thanks again :D

    Hiya

I have recieved my aknowledgement letter from MCOL but it states that it has been sent from Nothampton County Court, and HSBC's solicitors are DG in Birmingham. I live in Essex!!!!! Is this right, or have they issued my claim to the wrong court?

    Thanks for any help!

    Kelly

Hi i too live in Essex, mine is the same as yours, MCOL seem to deal with Northampon County Court as my Online claim went to them too. But when HSBC entered a defence the Claim was moved to my local county court. This is where i have to send back my Allocation Questionaire. And IF(reading other post sounds unlikely) i do have to go to court it will be held in my local Court too.
  • Hi all,
Just spoke to my local court, when/if your claim is defended and transferred to your local court there is a £100 fee when returning your allocation questionaire ONLY if your claim is over £1500 for all claims under this it is free of charge. Hope this helps out.

    Thanks for the info.

Does anyone happen to know if you can claim the £100 back?

    Thanks
