  • Five days to go before the bank need to have a defence filed, still nothing from HSBC through the post, and MCOL shows that they acknowledged on March 6th. Im keeping quiet, and not calling them quite purposely. Come next Tuesday, im rather hoping to apply for a default judgement against them - assuming the 28 days actually includes weekends. With any luck, i'll be writing something more positive this time next week!

    Not to put a downer on it, but i too was expecting them not to file defence mine finished on the Tuesday too and they filed a defence on the monday!! Couldnt beleive it :(

    Im kind of expecting that sort of antic from them, they have consistantly failed to play the game which is why im taking them to court in the first place:mad:
    Not heard a peep from them for 6 weeks now, no offers - nothing at all (but they are still taking interest though on my remaining overdraft which i'll pay off today). Never mind, if they wish to go to court then we'll go!

    Hmmm, this will be interesting - I'm seven days behind you on my claim for £4000 incl interest. How much are you claiming? There doesn't seem to be much consistency with HSBC claims so it's hard to predict what they'll do but it'll be interesting if you get the AQ from the court. Your 28 days is nearly up then?

I then sent my second letter on the 26th march which I know was only a few days ago but I was just wondering if it was normal not to receive anything at all. They've definitely recieved my letters cause i've checked on royal mail! is this normal!

    Took 3 weeks for them to reply to my first letter... So you're due for a reply to your first letter any day now. Don't think they have computers up there at HSBC HQ...

  • ha ha - it wouldn't surprise me if they didn't. Thanks for the reply. I rang them and they said they sent it to my other address which is my parents house so I'll so find out if thats crap or not. If I dont get a reply to my second letter within the 14 days should I start my court claim or should I give them a little longer. When I rang they said its taking about 8 weeks to fully sort out. Is this just a stalling tactic?

    I am also with HSBC on exactly the same timescale!
    I checked MCOL today and to my dismay after two pitiful offers, they have lodged a defense.
    I am claiming just under 2000.00. They don't seem to be treating all customers the same!!
    Can they lodge a defense after making two offers as this in itself must surely be seen as an admission of liability??

    Daughter in law claimed £485 on 19 Feb. Hsbc sent letter saying they can't do it in her timescale but then one week after time was up sent a letter offering £465. so she is well happy.

    Learn from the mistakes of others - you won't live long enough to make them all yourself.
