Hey guys... I am really unsure what to do now.

Sent my 1st letter and got a response saying I needed to detail what every charge was for (all were for going over my O/D Limit) - Louloujs advised that I do not need to do that... but should I send my 2nd, more threatening letter straight away (it has only been a week since my 1st letter) or should I wait until the 14 days are up and send it then.

    Man I am so inpatient!!!!!

    Hi Johnny

What exactly did you put on your charges spreadsheet?

It should have gone like this

Date of Charge - Nature Of Charge (Unauthorised OD - S/O recall Etc) - Amount

Then the interest if your adding it!!

I Would advised that if you have NOT sent a spreadsheet like that then you do so straightaway .. send your next letter enclosing the list of charges but extend the time-scale to 14days not 7 as it was your mistake

    Hope that helps

thats what i would do anyway!! :) xx

Infact, maybe you should ring up, tell them they were ALL for going o/d and ask if they require a new spreadsheey, if yes ask if you can fax it across

this may be the best option

(its abit early in the morning for me still!!) xx

I sent the one from the interest calculator as it shows you to do on this site (or at least I thought it did!!)

It just shows date and amount of charge, then interest, and a total at the bottom - no mention of what the charges are for

I've just been speaking with the customer services dedicated to the claims this morning i.e. the colin Langdale number (for the 3rd time) and am furious  that they've just told me they don't have my first letter asking for the £2,840 back even though I have a print out of the proof of delivery from the Royal mail website. They've been telling me (on the other two occassions I have phoned them), that they are aiming to complete cases within 6 weeks even though they are allowed 8 weeks to do it and are counting 9th March (the date of the second letter) as the initial contact date instead of the 20th February which is when they received the 1st letter.

I had tried on Friday to file to the court using the Money Claim online site but it kept saying it doesn't accept '&' and '>' and it wouldn't change it's mind even when i took those symbols out of my description so i gave up! I told HSBC I would file to the court before this happened and they now have those notes on my file and repeated it to me this morning so now i feel like a cop out  . I said i hadn't filed because I had been promised this would be resolved in 6 weeks and would give them the benefit of the doubt but having heard nothing for 5 weeks i was starting to get worried which is when it all came out in the open that they only have my 6th march (second letter) on file!!

I demanded they give me their fax number so I can fax the copy of the letter and proof of receipt (which i've now done) but the guy I spoke to either didn't sound hpoeful or was just a bit tired of saying the same old "I can understand, but you'll have to wait 6 weeks etc etc"

    WHAT SHOULD I DO???

Well, I phoned HSBC back that same afternoon (Tues) to confirm they'd received my fax which they had and guess what...............................I received an offer letter in the post yesterday (Wed) saying they are offering me £2,633 back!!!!!!!!!!!!!!!!!!!!!!!!!!!:D :D:D:D:D:D:D:D:D :rotfl: :rotfl: :rotfl: :rotfl: :rotfl: :rotfl: I'm so happy as it's only £200 short of my request - thanks Martin :money:

Thanks for the advice Louloujs - so do you think I should proceed with the 2nd letter (threatening court) now? It hasn't been 14 days but after that response maybe I should just get on with it. Maybe mention on the 2nd letter that the charges are all for going over my overdraft limit??

No - wait for the 14 days and then send the second letter. You have to do this by the book. You can't afford to lose your claim through technicalities - and not giving them the opportunity to respond within your timescales (even if they don't) is not proper procedure. It's not long to wait anyway!

so loulou... do you not agree that i should maybe send my 1st letter again along with the charges spreadsheet, but put in the letter that all charges were for unauthorised overdraft? I think it might be the safest option?

    Hi both!

Natalieee - :j Nearly there - hang on for that offer.

Johnny - I have used the spreadsheet on this site for my claims, it has worked successfully twice. You can itemise if you choose but remember in your covering letter you have stated what the charges are for. The time that HSBC are asking for to investigate the claims are meant to be for checking your claimed charges through anyway - They need to be doing something for the 8 weeks they're asking for!

Well, when i did mine i did an excel spreadsheet and also attached the interest calculator printout (soley for the purpose of the interest)

I think what you need to do is type up an excel spreadsheet, if ALL the charges are for unauthorised OD you should put for example

Date - Amount Of Charge - Description Of Charge - Interest Added - Total

Thats what i did, then put in the description - Unauthorised Overdraft

Mine Was fine - no problems

Then phone them, explain whats happened and ask for a fax number and/or email, then email and/or fax if poss then sed your list with quick covering letter TONIGHT by recorded mail

Then just wait and stick to your timescales !! x

Do you have to include the nature of the charge? Is the date and amount not sufficient enough information?
