To both of you I would say dont worry, dont be scared :) I researched HSBC for my OH and in all the success posts not one turned up at court and all settled beforehand.

Most banks say they intend to defend and dont actually do so. In that case you win by default.

If they do defend they dont actually turn up at court so again, you win.

Good luck to both of you, hold your nerve :)

How long does it take when a summons goes through to the bank.

Wrote 2 letters to HSBC and received no reply. issued papers in small claims court and have now received acknowledgement of service stating they intend to defend claim. Has anyone else experienced this and if so what happened. Am now a bit scared!!

HI I have also done this with HSBC and this morning i got a transfer of proceedings form to return to the court for a date. hopefully its acase of filling it in, paying the fee (£100, !!!!!!s!) and turning up on my own to court. everything that i have read and researched tells me that this will happen.

    Hiya Hun :D

Aww i know, some people got offers straight away (its not fair!!), But at least if your at court stage now and if you dont settle for less then you will get ALLL the fee's back PLUS interest!!

If i had the money i would have definatley gone to MCOL stage by now...but unfortunatley i dont so im just waiting, trying to be patient :rotfl:

Like you said you KNOW youll get the money back now, i hope its sooner rather than later for you

I rang HSBC today and spoke to a LOVELY man called Ian who said that an `offer letter` request is in somebodys que to write and i should ring back every day to check if its been written yet .. i hope hes not lying  im like you, i could do with the money in my hand RIGHT NOW!!

Let me know how it all goes hun :j xx

OHMIGOD - That means you're definitely going to get an offer. Reading what through a lot of people have said, they are actually sending offers out after 6 weeks or so - and a lot of people are waiting. I would wait and keep ringing before you go to the court stage. Remember that a few people are ringing up and saying that they won't settle for what they've been offered, but they will settle for £X, so stick to your guns and settle for what you feel you should get. Things are actually happening for you now though it seems.

I started reclaiming from HSBC at the beginning of this month. Received the infamous Colin Langdale letter and leaflet!! I e mailed the service quality team saying i was disappointed with their response, and giving my reference number...and surprise surprise i got a standard e mail back from them, but strangely i now have a case number!! Has anyone else had this?

I'm about to ask for charges from HSBC. Can i ask (nosey me) was it a lot of money you are trying to claim back?

I reckon they owe me about £200 - if that, do you reckon they would bother defending that, hardly seems worth it does it?

If you do have to file with small claims how much does it cost and do you get that back when the bank pays out or doesn't turn up.

Yes, I think that's standard procedure, but you're in their system. Keep going...
