    I posted my 1st letter asking for my money back on the 12th. Had no reply so was going to send off the second but just called royal mail about the delivery as it was recorded and she said there was no one there to sign for it and no-one has gone in to pick it up. That they would try and deliver again today but if there was still no-one there it would be returned. What do I do? It wouldnt surprise me if my local branch hadnt gone to get it on perpose or something :mad:. Should I send my second letter threatening court action to leeds or start again by sending the 1st letter to leeds? :eek:

    I dont want to start from scratch as I will have lost 2 weeks but what choice do I have? Is there one? :eek:

  • My b/f started his application to HSBC on 14th Feb and after Mr Colin Langdale nicely writing to him twice saying they will look into his complaint as he called it and then saying they would review things and make a decision on the 11th April my b/f started the online claims form last tuesday night (20th March) as he only has dial up though his comp kept cutting off so he gave up for the night. The next day the bank wrote to him offering him £3,500 they refused to pay the interest but still not a bad offer and he has accepted and sent the letter back last thursday so fingers crossed they stick to there 7day policy of it being in his account and he was happy his comp didn't work the previous evening as he would have had problems cancelling the online claim. So to anyone with HSBC hang in there

    I claimed back the small sum of a £12 'Admin charge' from HSBC credit card. They rang me up instead of replying to my letter and said they were entitled to charge £12 as set out by the OFT. I was just about to launch into a rant about how their admin charge actually cost them about £1 since it was automated, but she said she'd refund my £12 no problem before I had a chance!

    The banks are still claiming a £12 charge is proportional and fare - what is the reality of what HSBC claimed?
  • Hi I am new at this so forgive me if I am asking stupid questions. I bank with HSBC and have sent them the first letter demanding the 238 pound charges back but the 14 days are now up and I've heard nothing. I am planning on sending the second letter threatening court action but abit unsure on how to fill some of it out.
    Where it says insert name of court does this just mean the small claims court in my case?
    and where it says attach list of charges which charges does this mean? do I resend a copy of my statements with the charges highlighted? I am sorry if I am being thick i am just a bit confused. Please help me!

    Court is your local court I am in Scotland so Sheriff court here if you're in England I think its your local county court.
    Just send a list of charges (date amount and reason) if you want to add interest look the main site and use the calculator it's great and you can do a print of charges and interest and keep a copy.
    would save postage on all those statements. hope this has helped a bit
  • Another success story thanks to this website. I had an offer from HSBC through for £477 (claimed £536). Seemed a long winded process but worthwhile to get the money back in the end.

    So I would like to thank each and every member as each thread contains helpful tips and advice...

    Just a quick question. I've issued proceedings against HSBC and they have today acknowledged service. However, Im having problems logging into my internet banking - it says it doesn't recognise my password even though i know im inputting it correctly. Do you think this is this just a coincidence?

    Well my claim is taking a long time. Now in the courts hands !! I got a letter from HSBC's solicitors asking for a full breakdown of charges. I sent it to them last week and not heard anything since.

    They are obviously stalling now.

    What do you think i should do ??? Starting to get a abit worried now !

    They cannot cut off your internet banking just like that. You need to ring them regardless of anything if you cannot get into your account - someone may be using your account.
  • I take it from recent posts, you have to take them to court, is anyone getting an offer before starting court proceedings? Reason i ask is, i sent my letter threatening court action last monday, just wondering if its just a case of waiting til next week to start court proceedings or keep a bit of hope and hope for a settlement before the time is up.

    I believe this case will last no longer than one hour.

    I am respectfully requesting that my claim be allocated to the small claims track. This issue is not a complicated one; it is an issue of fact and not of law. The issue is only whether the money levied by the Defendant in respect of its customer’s contractual breaches exceed their actual costs incurred. I am happy to pay their actual costs and I am surprised the Defendant did not counterclaim for these, because I would have paid them without argument.

    However, the continuing problem is, (in common with the 100s of other cases currently being brought by other bank customers), that the banks refuse to reveal the details of their penalty-charging regime. As the banks have a fiduciary duty towards their customers, they have a duty to deal straightforwardly and in utmost good faith.

    Accordingly, I would respectfully ask that the court in this case, not withstanding allocation to the small claims track, order standard disclosure. I understand that it is in the courts discretion to do so. This would bring a rapid end, not only to this litigation, but would also likely bring an end to much of the litigation in progress against other high-street banks.


    Is this all I need to put on the Allocation Questionnaire?
    Bar ticking the relevant boxes I mean.
    I have plenty of willpower - it's won't power I need.
