    I take it from recent posts, you have to take them to court, is anyone getting an offer before starting court proceedings? Reason i ask is, i sent my letter threatening court action last monday, just wondering if its just a case of waiting til next week to start court proceedings or keep a bit of hope and hope for a settlement before the time is up.

    Weds - yes, there are plenty of people getting offers before going to court. There seems to be very little consistency in the way they're handling claims. I've got another few days before their 28 day deadline to file defence is up. I am assuming that they will, that i'll get my Allocation Questionaire and have to wait longer - this way, an offer in the meantime will be a bonus.

    The answer is, don't bank on an offer, just stick to your timescales. Good luck.

    I've just been speaking with the customer services dedicated to the claims this morning i.e. the colin Langdale number (for the 3rd time) and am furious :mad: that they've just told me they don't have my first letter asking for the £2,840 back even though I have a print out of the proof of delivery from the Royal mail website. They've been telling me (on the other two occassions I have phoned them), that they are aiming to complete cases within 6 weeks even though they are allowed 8 weeks to do it and are counting 9th March (the date of the second letter) as the initial contact date instead of the 20th February which is when they received the 1st letter.

    I had tried on Friday to file to the court using the Money Claim online site but it kept saying it doesn't accept '&' and '>' and it wouldn't change it's mind even when i took those symbols out of my description so i gave up! I told HSBC I would file to the court before this happened and they now have those notes on my file and repeated it to me this morning so now i feel like a cop out :confused: . I said i hadn't filed because I had been promised this would be resolved in 6 weeks and would give them the benefit of the doubt but having heard nothing for 5 weeks i was starting to get worried which is when it all came out in the open that they only have my 6th march (second letter) on file!!

    I demanded they give me their fax number so I can fax the copy of the letter and proof of receipt (which i've now done) but the guy I spoke to either didn't sound hpoeful or was just a bit tired of saying the same old "I can understand, but you'll have to wait 6 weeks etc etc"

    WHAT SHOULD I DO???

    I received my letter (which HSBC said i would, on Friday) as sods law would have it is was only a letter stating they would get back to me by the 18th April ..

    Ive looked through peoples posts and it seems the average time it takes to get an offer is 5/6 weeks..

    Alot of people who had april 12th deadlines seem to have already received their offers so im just going to wait ... AND RING THEM EVERY DAY WITHOUT FAIL TO NAG :D

    If i dont get an offer by next Monday I WILL BE filing a claim against them for definate...

    I just want my money, my birthday celebrations have cleaned me out completely, i may have to take up busking or somthing! (haha) :rotfl: xx

    Wrote 2 letters to HSBC and received no reply. issued papers in small claims court and have now received acknowledgement of service stating they intend to defend claim. Has anyone else experienced this and if so what happened. Am now a bit scared!!

    Hi Nat - yes, i'm really miffed that so many people are getting offers without going to MCOL. I just got the two 'Colin' letters which were just stalling tactics. I filed online on the 9th March and they acknowledged it so i've got to wait another 10 days until i can request judgement but having read other people's stories i'll probably get the AQ and then have to wait all over again - and pay £100 for it.

    Feel really p'd off now because I could do with that money badly. On the positive side, I know i'm going to get it - and the interest because the claim's gone in - I JUST WANT TO KNOW WHEN!!!

    Aww i know, some people got offers straight away (its not fair!!), But at least if your at court stage now and if you dont settle for less then you will get ALLL the fee's back PLUS interest!!

    If i had the money i would have definatley gone to MCOL stage by now...but unfortunatley i dont so im just waiting, trying to be patient :rotfl:

    Like you said you KNOW youll get the money back now, i hope its sooner rather than later for you :cool:

    I rang HSBC today and spoke to a LOVELY man called Ian who said that an `offer letter` request is in somebodys que to write and i should ring back every day to check if its been written yet .. i hope hes not lying :confused: im like you, i could do with the money in my hand RIGHT NOW!!

    Hi tilly i am also at this stage and i am also a bit scared,i have until the 12th April to send the Allocation form off which i phoned my local court and got some help with.I have heard that they do pay before they have to go to court,lets hope they do.Good luck with yours.

  • Hi. I also received the same letter today, that HSBC are defending. I also am a bit scared / unsure now, so have posted a question about what actually happens in court as I'm a firm believer in get as much information as possible before you go into a new situation. Have a look at my post and hopefully someone will give us their experince to help us feel less scared!!
