    First of all, huge thanks to Martin who started all this!

    Partial success! I followed all the steps here, but it took a while (a) to get them to send me all my bank statements as I only had 3 years' worth and (b) finding the £120 to go to Court!

    However: yesterday I received a letter offering me £1776.75 in full and final settlement (my claim was £3553.50 PLUS interest PLUS court fees) - They say I can't expect not to pay any charges at all... I need to do some sums. My overdraft is nearly 1700 due to my having to increase it all the time to cover the bank charges in the first place!

    1st letter requesting £2258 sent 22/2
    2nd letter threatening court and offering to settle for £2100 out of court sent 9/3 via recorded mail,still not scanned in on 13/3,rang service quality team,asking whats happening,they said there was no record of my 9/3 letter :mad: saying they obviously hadnt recieved it,i said yes they have as it was signed for on 12/3,so i rang again through the week, on 15/3 it was scanned in but not being investigated yet,told them il give them until monday 19th then i would start court proceedings,rang again monday after nothing arrived in post,and was told there was no letter dated 9/3 on their system for us,then when i got a little mad she called someone down from charges team to look,and he found it under my name not joint names and said as they made a mistake we would get back what i agreed to settle for within 7 working days :T :T :T , or so i thought,then on 21st i had a thought,everyone on here had to sign an offer letter,i rang them to check and yes we had to before the money would be credited to our account :mad: lied to on monday! then i was told that i wouldnt know the amount they offered until the next day as they cant tell me the amount until day after posting :confused: waited and rang today,told sorry but there is no offer or offer letter :mad: :mad: :mad: what!!!!! surely not. put the phone down and rang back 5 mins later (no hold for once,straight through) this time i was told that they had 8 weeks blah blah blah so i stopped her in her tracks and asked to speak to someone higher up,was put on phone to charges manager,he said yes there is an offer,it was posted yesterday,i said well what if this is more bulls**t and he said the offer is for £2100 as i had agreed to,and gave me his name and fax so we could get it straight back when it arrived and apologised profusely.......then when post arrived today,offer letter was in it, £2100 like he said :j :rotfl: :j :rotfl: :j at least someone there knows its best to tell the truth and get stuff sorted, thank you mr manager (who also wrote of £75 of extra charges on my account whilst on the phone today) :A

    total claimed £2258 no interest (would be £2530 inc int)
    total offered £2100-accepted and faxing back today

    :beer: good luck everyone else, my advice-bug them as much as possible on the service quality team number 08456028006. 4 weeks start to finish! so worth the stress in the end.
  • To all those who have been there, done that :D

    Today I personally returned the completed AQ to the Courts with the £100 payment. T'was very hard to hand over that cash knowing that the bank has already cost me a fortune.

    Anyway, question is, What happens now? Do I just sit and wait for the court to contact me or what?

    Btw, does the £120 to MCOL and the £100 for AQ get added to any settlement that I might, nay, that I will receive?

    IF I have to attend the court hearing, can I claim for the days lost earnings? I'm Self Employed so, no work = no pay

    OK I am sending HSBC my first letter on Monday, asking for just under £300 back with breakdown of charges and interest attached.

    Am I correct in addressing it to my local branch?

    I have managed my account very well over the past 2 years and have not incurred any charges in this time (although I have been living in my authorised overdraft for all of this time) - how likely are they to close my account? How likely are they to demand that I repay all of my overdraft immediately? (Although I work part time, I do not have the funds to do this all in one go, but would be able to make a regular payment towards it)

    Also, am I likely to have to go to court for this £300, or are they more likely to just refund?

    I wrote the draft letter on this site to HSBC some three - four weeks ago and didn't have a reply at all, just sent the same letter again with a covering note... will give them till end of week to reply then take next step.

    Hopefully the bank will contact you with an offer of your full claim and as you have now gone through the court process you will be entitled to the court costs and the interest. Should you end up in a court hearing yes you should be able to add expenses.
  • Hi I am new at this so forgive me if I am asking stupid questions. I bank with HSBC and have sent them the first letter demanding the 238 pound charges back but the 14 days are now up and I've heard nothing. I am planning on sending the second letter threatening court action but abit unsure on how to fill some of it out.
    Where it says insert name of court does this just mean the small claims court in my case?
    and where it says attach list of charges which charges does this mean? do I resend a copy of my statements with the charges highlighted? I am sorry if I am being thick i am just a bit confused. Please help me!
