No rush to get the claim in before the OFT - take your time and get the claim right - thats a lot more important than beating the OFT non-decision ;)

  • hi.
i am a long way through the proccess of reclaiming £750(900 with court fees and interest). I refused the offer of £650 and am wondering if i did the right thing. I today recieved a letter from a solicitor representing hsbc requesting another breakdown of charges. is this just posturing or are they gettin hacked off and about to make a stand? should i follow this through with the questionare and correspondance with the solicitor? will they make another offer?

alot of questions i know but thats just some of the ones in my head.

    DG Solicitors- Help!

    Hi,

HSBC have put in a defence, I have completed the AQ. Today I got letter for DG. Asking for a breakdown of charges. Is this necessary again? And if so shall I recalculate the interest to today as the original calculations were made in Decemeber.

    Any advice greatly appreciated.

and to birdmanjon, just send them off a copy of your list of charges with dates, descriptions etc even if you have already done this. The interest should be recalculated when you file online as this is the point that you are actually entitled to interest.
  • A few questions about threatening court action.

In the letter you give them 14 days, but most on here are only offering 7 days, is there a set limit i should give them, im thinking about giving them 10 days to respond?

Also do i put my local court or another one?

    Thanks

Give them 14 days and put in your local court or if you don't know the name leave that bit out of the letter.
  • Hi everyone,

Today I received a letter from DG Solicitors requesting copies of spreadsheets etc., Which I sent by recorded delivery this morning.

On reading everyones posts it seems that everyone else has received an Allocation Questionaire almost straight after the solicitors have acknowledged the claim and said they are going to defend it.

Have I got this right? Or am I just getting myself into more of a 'kerfuffel' than usual?.

Would hate to muck things up this far down the line.

    Many thanks in advance

    Any answers pleeeeeeeeeease?

step 1 - get statements using DPA letter
step 2 - send prelim letter
step 3 - 14 days later send Letter before action
step 4 - issue court claim using the N1 moneyclaim form.

    No you're in a kerfuffle :)

The allocation questionnaire won't come until you receive the copy of the banks defence from the court which SHOULD be about 28 days after your claim was served.
