Just recieved my whole wad of duplicate statements but wondering if any one knows whether
1) I can claim for charges that have been made on my Buisness account
2) i wonder has anyone had any dealings with Hounslow Branch , Middlesex

1) Yes you can just dont quote the consumer law in your claim as it doesnt apply.
2) Use the head/registered office address to correspond with and to serve your court claim on.LegalBeagles0 -

banks have been routinely defending claims for a fair while now....except natwest and rbs who have gone the other way

thanks for that. i included interest in my original claim and hsbc said they 'dont pay back overdraft interest' - duhh i dont think they realised i was claiming interest on ALL my charges not overdraft interest that i was charged by them!
so just to clarify - the £80 that i paid for MCOL wasnt in my original claim amount so how can i add this now? thanks again
your court fee will have been added to your MCOL when you submitted it so it is a part of the claim now....and yes the bank prolly did get confused with the interest element of the claim in your letters - as the statutory 8% doesnt apply until court.....they'll pay it now don't worry.LegalBeagles0 -

Having said that. DG Solicitors have until 24th March [this Saturday] to file their defence. Being 28 days from the claim being deemed as served. I think thats right?

Sorry to be a pain in the bum.
When I received the notice of issue from MCOL it states 'Your claim was issued on 19.2.2007.............and it will be deemed to be served on the 24.02.2007.
Then I received a Notice that Acknowledgment of Service has been filed. 'The defendent now has 28 days from the date of service of the claim to file a defence'. Now I took this to mean 28 days from 24.02.2007 as above.
I have just checked my claim on MCOL and it states that 'the defendent has 28 days from acknowledgment of claim to file a defence'. DG Solicitors acknowledged the claim on 21.02.2007.

HSBC only seem to have sent me 3 years of statements and not 6? Has anybody else had this problem?0

Dragon Lady - they have 28 days from the 24th.
I think you may be reading something wrong on MCOL....anyway I wouldnt worry too much they'l probablybe late with the defence and it you're not 100% of the dates it will keep you finger away from that default judgement buttonLegalBeagles0 -
Bigs Hates - write thanking them for the 3 years and ask them to send your remaining statements forthwith or you'll consider reporting them to the ICO if they dotnt supply them wihtin the 40 laid down bby the Data Protection Act.LegalBeagles0

Hello,
I am just looking for a bit of advice with regards to reclaiming my charges. I have gone through 3 steps of reclaiming charges and I have made a request to HSBC to pay my requested amount. I have had 2 letters off them saying that they are investigating my query and will provide an answer by 7th of April.
Should I assume this is a delaying tactic as they wait for an official OFT opinion or should I send a letter threatening to take them to court or just wait with regards to the outcome of their investigation?
Any assistance or opinion is welcome.

Don't wait for the bank, you will be waiting a long time!
The advice is to stick to your own timescales, so however long you have given them respond, stick to it.
