I sent my LBA on the 6th March, their 7 days would have been up on the 14th. I called them last monday, wednesday and thursday, saying if i had'nt heard anything by the thurs I would be going to court. All I was told was that they wer'nt giving any timescales. Anyhow as luck would have it i've just recieved an offer of 88%:j , (£1858 from £2111) which I'm accepting, was a bit of luck really as i could'nt afford the court fees!:rotfl:
Just have to wait and see if they pay up now!

\hi - I have had a similar scenario with HSBC. I got fed up with this so filed with MCOL. A letter arrived from HSBC the very next day (crossed in the post) offering me £800 less than I was asking for and stating that they would not pay my interest as it was not appropriate (!!!)
Now that I have filed my MCOL, I am going to stick to my guns and wait for the Courts to decide. Incidentally HSBC have acknowledged my court claim and intend to defend it. I was at first very worried at this, but having read through ALL the threads about HSBC tactics, I am not worried now. I am just going to sit back and wait for any court correspondence/HSBC correspondence to feed through.
It is just as everyone says it is, a waiting game and a battle of nerves. I will not deal with these people over the phone (not courageous enough!!) so I have done everything through paperwork and am looking forward to the end result, whatever.
Hold your nerve and read through everyone's posts.0 -
so i should send off the "Threaten to take it to Court" letter today?
Also before i have been sending the letters straight to the branch, should i send this to the person who is "looking into my matters"?
Thanks0 -

The Claimant has an account XXXXXXXX (put your account number) with the Defendant, opened (DATE XX/XX/XXXX). Since (DATE XX/XX/XXXX) the Defendant debited charges and interest in respect of purported breaches of contract.Defendant is aware of all details as a list of charges has already been supplied. Claimant contends: The charges exceed the Defendant's losses caused by the breaches; The Term permitting the Defendant to levy such charges is unenforceable under the Unfair Terms in Consumer Contracts Regulations 1999, Unfair Contract Terms Act 1977 and at Common Law. Claimant claims: return of the amounts debited of £XXXX; Interest per S.69 County Courts Act 1984 of 8% - £xxx [enter interest total at date of claim] continuing at 8% until judgment or settlement at a daily rate of £0.xx; Alternatively, if the charges are a fee for a service, then they must be reasonable under S.15 of the Supply of Goods and Services Act 1982. Costs allowed by the Court.
The claimant claims interest under section 69 of the County Courts Act 1984 at the rate of 8% a year from {date when the money became owed to you} to {the date you are issuing the claim} of £ (amount of interest only) and also interest at the same rate up to the date of judgment or earlier payment at a daily rate of {enter the daily rate of interest} To work out the daily interest. Multiply the amount of your claim (charges only, not including interest) by .00022
