Ive looked thro a few pages and cant find an answer to mt question.

I sent the letter requesting repayment on my bank charges, ive received the usual were looking into it response, but the time is up, so i want to send the letter threatening court action, but do i send it to my local branch or to Leeds?

    Thanks

snd the letter to the leeds address, your branch will only have to send it on to leeds anyway which will delay the process. I sent my husband claim off to the branch and he's still not received an acknowledgement 3 weeks later. Good luck

Today I received an offer from HSBC of £1,462. My claim was for £2,206.17

I would appreciate any feedback or advice on this, as I would like to continue and push for the full amount I initially claimed, but am a little concerned by some of the wording in the letter.
It does say the offer of £1,462 is "in full and final settlement of the matter"
It also says at the top of the letter "Without Prejudice". If i refuse the claim and continue to the next stage, am I able to ever go back to this offer, if i pull out of court proceeding ?

If i do decide to start court proceedings, do i need to inform HSBC, or will they be informd by the court?

    Thanks

My advice is to do what many others have done and go for the full amount. I sense this is what you want, so go for it. Hopefully you won't pull out of the court proceedings, as once you've filed the claim, you're very close to getting the full amount back.

If you were to accept this offer and sign the letter, it would be binding and you would not be able to make a further claim in respect of these charges.

You inform HSBC in your Letter Before Action, but after this you need not tell them again.

    thanks nickmack and fuzzybear01.

Nickmack, I have already sent the LBA, and it is in reponse to this that I received the offer. Is it now not neccessary to tell the bank i'm taking them to court? should I write and says thanks but no thanks to the offer, or just proceed to court stage ?

You needn't contact them again, when they get the court papers, they will soon realise you're claiming for the full amount.
  • Hi Nick,

Thanks for your prompt reply. I did look under your reclaim help thread and I may be being thick, but I could only find an address for Halifax.

Sorry to be a pain, but could you tell me where I find it within the thread.

    Many thanks,

You're not being thick, oops, the thread has been moved due to an 'administrative error', the link you need is:
